Tenant unable to pay rent again. Latest excuse is company is going under. Wants to know if i could give her and her kids 2 months to move. No drama, no discussion, I just file eviction. Magic, the day after the sheriff delivered the eviction filing notice, she deposits the rent into my account. Magic !

It's a well proven fact that eviction notices generate money for your tenants. You should do them a favor and file more often! --141.129.x.xx

Today I will be filing an eviction. I doubt I will be as lucky as you were. Did your tenant pay your filing cost too? --69.244.xx.xx

No I only get filing costs if I win. But my filing costs are $22, and that includes service. --173.66.xx.xxx

I make my tenants pay the filing costs. It's $30 to file plus $35 for the process server. They pay both or they don't stay. --141.129.x.xx

Here the filing cost are $249.00 !!! I have had only one tenant pay both back rent and filing cost to stop an eviction and I doubt that will ever happen again. --69.244.xx.xx

Laura, fees, fines and current damages are the first part of spending the payment, so your tenant will have a higher payment next month to catch up, be sure to send them an itemized bill using cert mail return receipt. --75.94.xxx.xxx

Laura,

If you rub the papers a Genie pops out with CASH!

We add the filing fee ($91 here) to their account. Unpaid balance is viewed as unpaid rent for eviction. --67.175.xx.xxx

Wow! Filing cost only $22?!?! It's $237 here in Chicago. Never had a tenant paying for filing to stay. They couldn't pay rent, let alone rent + filing cost. --198.29.xxx.xxx

My filing fee is only $20 in the towns and villages and $45 in the cities.I do the paperwork and service for other landlords for $175 so if my tenant wants to stay they have to pay me the $175 and I get that fairly. --24.92.xx.xxx

Our most recent tenant has gotten behind 1.5 months in the rent, yet has the funds to travel to s.c. to see new grandbaby. Guess I know where their priorities lie. --69.161.xx.xxx

Melinda, I have a new position on that - I too used to say "they have gotten 1.5 months behind".

No more.

I now say "Who is the lousy manager that is LETTING them not pay?" (ME! Then we evict.)

Set a deadline they will believe and half will pay, like Laura's and 3000 people in Detroit. (see my post about FREE WATER IN DETROIT." --67.175.xx.xxx

It's a well proven statistic that once a tenant is more than a month behind, their chance of ever catching up is very slim.

The answer: don't let them get that far behind. File eviction when they are a WEEK late, not when they are 1.5 MONTHS late. --141.129.x.xx

Magic Again (by Chris [CT]) Posted on: Jul 22, 2014 3:22 PM

I never let my people get behind. By CT law they have until the 10th, and I give them another week. At that point its cash or eviction.

As said above once they are behind a month or two they will never catch up. --162.198.xx.xxx
