State Specific Question About: SOUTH CAROLINA (SC)

Since Jun/2013, a family rented our Condo. One year lease was over by May/2014. Most of the months they paid their rent very late. As they were struggling to pay the rent, we helped them by forgoing most of the penalties for most of the months. Misunderstanding between the wife and the husband, made the wife to move out our condo at the end of May/2014. Husband leased our Condo for 2 more months (namely June and July 2014). The husband said he was vacating our condo by July 12, 2014 and agree to pay $1500 on that day. The remaining $400 on July 26, 2014. In the meantime, the husband and wife got back together and moved jointly to another rental property (we don't know the address). They removed all their furniture but DID NOT handover the keys yet and DID NOT PAY THE RENT FOR TWO MONTHS AND 12 DAYS. The two month extension is over by June 30th. THEY ARE NOT ANSWERING ANY E-MAILS OR PHONE CALLS. What do we do next? --97.89.xxx.xxx

I would press suit for monies owed and seek for abandonment of the lease you have. And try to get the right to change the locks so you can re-rent it as soon as possible. Look to see if anything was left behind and you will need to get a form that allows you to remove this stuff and place it in storage. Abandoned stuff. It just wonderful how the law allows these types to get away with this. I would also go for eviction and pay the monies so that they would have to show up in court and if not they would then have an eviction for non payment on their credit reports for 10 years. It will cost but you will be doing everyone else a favor who owns a home and rents. Im evicting someone right now also. So I know what you are going through. --72.87.xxx.xxx

See if you have anything like the following in your state statutes.

I use it a lot when they have up and moved out. Cost me ten days but much cheaper than court.

Also note that # 1 has a semicolon after it and # 2,3 has the word AND after them. Therefore I believe #1 stands by itself and I could go in immediately but I always wait the 10 days.

Chapter 441

Landlord and Tenant

Section 441.065

August 28, 2013

Abandonment of rental premises, when, procedure.

441.065. Any property of a tenant remaining in or at the premises, after the tenant abandons the premises, may be removed or disposed of by the landlord without liability to the tenant for such removal or disposition. The premises shall be deemed abandoned if:

(1) The landlord has a reasonable belief that the tenant has vacated the premises and intends not to return;

(2) The rent is due and has been unpaid for thirty days; and

(3) The landlord posts written notice on the premises and mails to the last known address of the tenant by both first class mail and certified mail, return receipt requested, a notice of the landlord's belief of abandonment. The notice shall include the following, where appropriate:

"The rent on this property has been due and unpaid for thirty consecutive days and the landlord believes that you have moved out and abandoned the property. The landlord may declare this property abandoned and remove your possessions from this unit and dispose of them unless you write to the landlord stating that you have not abandoned this unit within ten days of the landlord having both posted this notice on your door and mailing this notice to you. You should mail your statement by regular first class mail and, if you so choose, by certified mail, return receipt requested, to this address . . . . . . . . . . . (here insert landlord's name and street address)"; and

(4) The tenant fails to either pay rent or respond in writing to the landlord's notice within ten days after both the date of the posting and deposit of such notice by either first class mail or certified mail, return receipt requested, stating the tenant's intention not to abandon the premises.

If all the furniture is moved out then the tenants have abondoned the rental unit. Here if all the furniture is removed then the locks can be changed. Take pictures to show there is no furniture in the rooms. More then likely the unpaid rent was used to pay first and last months deposit on the rental where they moved. Here a lot of new rental housing providers don't run thorough credit checks on all adult applicants which leads to disasters like this. Consider joining a landlords association where one needs to learn how to screen out problem tenants along with learning how to run credit checks. One can google to find one near the rental or continue to learn from the school of hard knocks. --173.243.xx.xxx

Start learning your court rules about timing for notices, with the ongoing overhead of condo fees you need to learn your state and local tenant laws so you can enforce your -legal- lease in a timely fashion. The unpaid rent is kinda lost from sitting on your hands not knowing what to do, converted to education cost. Regarding the damage deposit be sure to send an accounting statement showing the usage towards rent, late fees.

Hopefully this condo is profitable, many here talk about the condo as a sinking ship - which it often is with climbing costs you have no control over and besides state and local tenant laws you also have to follow the condo laws. --75.94.xxx.xxx
