State Specific Question About: COLORADO (CO)

My tenant's lease expires August 31. What is the time frame in which I need to tell my tenant if I plan to not renew her lease? --174.22.xxx.xxx

Unless your lease has an automatic renewal clause in it, technically no notice is required. When the lease is up, it's done and there is no written agreement. The tenant should vacate. Most people don't know that. Many of my tenants think after they have stayed a year they are on a month to month agreement. My lease says otherwise but they don't know that.

Most leases have clauses that deal with hold overs and renewals so you need to read your lease and see what it says.

In Colorado, 10 day notices is all that is required to end a month to month agreement unless the agreement specifies otherwise. You should know that most written agreement address this issue so don't assume 10 days is correct.

In practice 30 days is acceptable. Gives the tenant time to find a new place.

If you want them out but they don't move, don't accept any rent for September if they don't move at the end of August. If they stay past Aug 31 you would need to post notice and begin eviction. --75.160.xxx.xxx

Great helps, Bill and Colin--thank you! I'm still trying to figure out if I oust her or not. She has no deposit (I inherited her with my purchase 3 months ago), a cat who two inspectors have said makes the place smell, heaps and heaps of clothing on bed with no sheets but apparently her little girl sleeps there in a hole carved out of the mess. She has extra electrical cords with 3 TVs by a window left open during the day and rain came pouring in and was standing in pools on the sills. She decided to pay me in partial payments so gives me half at the beginning of the month and half partway through and says she will take care of the extra daily charges but has not so far. She also gave me grief about my raising her rent $15 (still below where the others are) and adding in a 4-way utility split (water, ww, gas, and trash) among the units as I bring new people in and write new leases. I'm not sure if I keep her, tell her to shape up, or tell her to leave. Now I know I have until the end of the month to decide since her lease is up end of August. Thoughts? --174.22.xxx.xxx

Side note:

If somebody sells a tenant occupied property in Colorado, they must either:

1.Transfer the security deposit, or the remaining portion of the deposit, to the buyer and notify the tenant in writing that their deposit has been transferred to the new owner. You must mail this statement to the tenant and include the new owner’s name and address.

Or

2.Return the security deposit, or the remaining portion of the security deposit, to the tenant.

Once the transfer is complete, the new owner becomes liable for the security deposit and for following Colorado’s security deposit laws. --99.126.xx.xxx

So this lady evidently did not put down any security deposit. The owner or manager who allowed her in was in or near bankruptcy apparently, and hence the slip-up. Before buying I verified this issue and have previous owner go to tenants and sign estoppel certificates to say that there was or was not security deposits with each of the tenants and she did not have one. Should I have required the previous owner to pay me the $ that the owner before him should have had in a security deposit? They almost did by mistake and I spoke up at the closing and said this is too much and so they took it back. So much for being honest:)! --174.22.xxx.xxx
