State Specific Question About: PENNSYLVANIA (PA) Tenant [Former section 8] is an illegal holdover. Water bills in my name. She not paying full rent. How do I go about legally shutting off the water service?

Unfortunately, you can't. You have to go through the court system and evict. Only the water company has the right to turn off the water for a non-paying customer. --23.228.xxx.xxx |

Some jurisdictions rent not paid in full one can evict. In Ontario if a tenant owes a dollar in rent then one can evict. Contact a landlords association where one can get help with the eviction. One can google to find one near the rental. Also consider contacting the section 8 office where they should be told the tenant has breached obligations to pay rent in full. Absolutely do not turn off any utilities as this will cause serious problems with the eviction. --74.220.xxx.xxx |

Did you try calling the water co? We found out way too late our tenants hadn't been paying water bill entire time and bc a shut off notice had been sent we were allowed to request the water be shut off and not turned in until paid in full. The tenant only knew it was shut off due to nonpayment. Now I think technically this could be interpreted as uninhabitable and you as ll can be held accountable even tho lease says they are responsible for water. It would have to be an extreme judge. In our case the tenant owed almost 2k so judge couldn't really argue w water being turned off at eviction-but we paid out of our own pocket to get it back on a week before court just in case. --108.66.x.xx |

Liz: In this case, the water is in the LL's name, not the tenant's name. If it is in your name and you shut it off, then that is a "self-help eviction" attempt and is illegal pretty much everywhere.
Yours was a bit different because it was in your TENANT'S name. If they don't pay their own bill and it gets shut off, then so be it. (On a side note, if it was in their name and you called and had it shut off any differently or earlier than the water company would have done it on their own, then that was also likely illegal and you should not do that in the future.)

Liz, did you have a chat with the manager of the water company? sounds like they have the wrong process in place if they ALLOW a customer to run up $ 2,000 in unpaid bills!!
Was shocked seeing SCE letting a friend's deadbeat tenant continue get electricity while owing a 4-digit amount!

It amazed me too how high some of these bills get. Last summer I had a tenant who as it turned out never paid her electric bill from the beginning of her tenancy. We had quite a number of record setting high days. In her case, they could not shut it off because in my area they can't shut utilities off in extreme heat (or cold for that matter). If it's very hot every day, like last summer, it never gets cool enough to legally shut it off. --65.27.xx.xxx |
