State Specific Question About: GEORGIA (GA)

I'm filing a Dispossessory proceeding in Clayton County Georgia magistrate court against a tenant that is two months behind. If I am awarded an eviction does the court give me the writ of possession and send it to the sheriffs office or do I have to file for the writ of possession and take it to the sheriffs office myself. I am new to this process can anyone help --108.80.xxx.xx

Here in PA, you have to go back to the magistrate to get the constable. To my understanding, that doesn't involve another hearing but is a procedural thing one does. Your magistrate should be able to provide guidance. --207.172.xx.x

Can not say for sure. But the process in the province of Ontario is once has the writ of possession then one must go down to sheriffs office to enforce the writ of possession. After paying over $400.00 dollars the sheriff posts or hands the notice to the tenant if the tenant comes to the door that the locks are going to be changed in seven days. Often they leave on the sixth day they leave only garbage behind where one changes the locks. Often non-paying tenants know the eviction sheriff drill as for them it is a way of life. Here the tenant biased rental housing tribunal mails the writ of possession where after the extended time period the tenant has the last chance to pay the arrears. In future running a thorough credit check on all adult applicants is like spending pennies on the dollar when compared to cost of a eviction along with thoroughly trashed out rental unit. Finally they are no longer pennies in Canadian currency as the amounts are now rounded out. --74.220.xxx.xxx

In my county, you or a lawyer needs to do al that and pay the Sheriff his fee. Wish they would turn their cash flow issues into a business opportunity and offer 48 hour service for say $ 100 extra. Waiting for WEEKS doesn't serve justice! --61.7.xxx.xxx
