State Specific Question About: ILLINOIS (IL)

A tenant moved out due to no electric( her fault) she was stealing electric after it was turned off for non payment. She moved out and left a lot of property behind. How long do we have to hold on to her property before disposing of it? what is the timeline for considering it abandoned property? --76.16.xxx.xxx

You need to follow your state laws first then your local rules which affect timing of this type, when in court it is a good idea to ask if anything left can be discarded - some judges ask why did you leave this for a week if it was valuable? --75.94.xxx.xxx

If the electricity is disconnected then the tenant will not be coming back to occupy the rental unit. If there is emergency contact number on the rental application then try to contact the tenant. Some jurisdictions one can give to charities what is useable then dispose of the unsanitary stuff right away. Each jurisdiction has a different set of laws regarding abandonment. Try to contact a landlords association to see what rules apply. One may have to go for a eviction where one may need a sheriff to change the locks. Sandy, The Emergency Contacts form I distributed at Convention gives the LL permission to contact or "DELIVER to the following trusted persons".

We either deliver it to her new home or to one of the contacts she designated.

We post an ABANDONED PROPERTY NOTICE (also distributed at Convention) on the door which says we'll be removing any items in 48 hours, disposing at management's discretion.

We take photos to prove there is nothing of value remaining.

Broke people don't leave stuff that has value.

If there is anything that MIGHT have value, we label it and stack it in the corner of our storage garage. Most states require 30-90 days. Check your law. Not hard. It's in the link at the top of this page.

GOING FORWARD, work with your tenant when they are leaving ... on good terms or bad. Get them to sign a document that says they are returning possession of the property to you and any items left behind are abandoned and you may dispose of them. --174.55.xxx.xxx

We tried working with her, she has 5 months left on lease. She is behind on rent 1 month, after they turned power off for non payment she had someone rip off the meter cover and was stealing elec. Elec company had to disconnect at the pole. will cost $2500.00 to fix and replace meter and box. Town came by after electric and placed an sticker that the premises can not be occupied due to not having electric. We have attempted to call her about her belongings and she will not return a call. Thank you very much for your responses I apperciate them.
