I have a tenant on section 8 who has not paid her portion of the rent last month and this month. She is fully aware of this being due but has chosen not to pay this. I have sent her two letters telling her to pay this but so far she refuses. She recently called in an to the housing office asking for an inspection and they found some problems. We are working on making these repairs but she has hung up on my contractor 4 times and refused to let him in the house. I notified housing and they are going to talk with her on this. However, I am about done with this lady. I am tired of her bad attitude and her not paying her rent. I know it is going to be a bit of a battle with her to get her out and I will lose the cash coming in from section 8 if I kick her out, but I think I have no over options. Question: if I issue her a 3 day notice to vacate and she doesn't pay her portion (but housing does) I wonder if the judge will still evict her? I know that if a portion of rent is paid then that could be a reason to not grant this. Thoughts?

In Calif, I evicted a Sect8 tenant for nonpayment of her portion of the rent only.

I did use an attorney, as this was our first and only eviction.

The court papers were filed asking for only the tenant's unpaid portion.

If you tell housing office that you're going to evict for non-payment, they might explain to her that she can lose her voucher due to eviction.

Report the non payment of rent,in writing, (certified mail?) to her case worker. Make as much of a, polite, paper trail as possible. Then start the eviction process, today!

Once a sec 8 tenant goes "ghetto", there's no going back.

I know every HUD office is run differently, but If my sec. 8 tenants don't pay their portion, they loose their voucher. Cross your T's and dot your i's and they will pay.

As a side note....a hard earned fact about sec 8 is that you have to 'approve' their 30 day notice.....The way it is interpreted here, is that if I say they haven't fulfilled their move out requirements...They can't move...I say "No, I don'rt accept your 30 day notice." "You need to do this and this and this"...... If they don't, they can't move and they loose their voucher. Trust me, if you don't "insist" on "performance" it won't get done.

It is the one small moment of control we have over our sec. 8 tenants.

Record that she is not allowing repairs to be done. Start the eviction as things are only get worse. Try going down to the Section 8 office to explain that repairs will always be done. As long as there is no building code or fire code violations then the rental is considered in habitable condition. Try to contact a landlords association where one can google to find one near the rental. One may need some help with this situation. --74.220.xxx.xx

You have to repay the housing office portion, and be certain to get the receipt time/date stamped to prove your refund, the tenant should be paying into your court escrow, check this like any other repair hold. Proceed to evict per your local timetable. --75.94.xxx.xxx

So, I gained access by going into the property today with my contractor and made a list of repairs needed.

We also served her a 3 day notice to vacate if she doesn't pay her portion of the rent in three days we will begin proceedings.

We will proceed to make repairs and hope she comes through, but will evict her if she does not, no exceptions.

In the meantime I am going to have to write all of this up and send over to housing. Fun, fun... --50.84.xxx.xxx

Here we refund the hap portion to allow the eviction to proceed without any obstacle, hap does pay that portion for each month until tenant is out unless a dangerous situation exists - smoke detector failure is a 3 day must be fixed, same for sewer problems - even when the tenant puts cement into the drain, yes I had one do this and 6000 in other damages in 60 days it took for 2 hearings getting them out. --75.94.xxx.xxx
