State Specific Question About: NEW JERSEY (NJ)

I have a tenant that has been a little unpredictable lately. She always pays in cash. She only made a partial payment this month (in cash)

How do I prove when the payment is received?

Does accepting partial payment qualify as her paying the rent in full? --50.182.xxx.xx

We do not except partial rental payment from our tenants. This a red flag that the tenant is strapped for money. We tell your tenants that you pay your rent first, the you pay what bill you have to pay. If they do not give us a full payment we give a five day notice because my mortgage company will not except a partial payment from me.

I do not pick up rent. 99% of my rent payments are online.

To prove the date, you could write a receipt. Or, if they pay by depositing at the bank or paying online, you will have a clear record of what was paid when.

I have not heard of a partial payment waiving the right to the rest of the rent, but in some areas a partial payment will stop or delay an eviction. Issue a receipt showing a balance due. --68.46.xxx.xxx

that is why we do not except partial payments, it in our lease states that full rent payments are accepted only on or before the first of the month. Because we have done it in the past and every time we done this they can not pay the rest.

Our Lease Agreement clearly states if partial payments are accepted it does not mean it is accepted as payment in full for the entire month's rent. Partial payments are a definite sign the Tenant is struggling. I still can't see turning money away while initiating the appropriate legal action since rent is still delinquent. --71.182.xxx.xxx

I get the not accepting partial rent and I wish sometimes that I wouldn't because it's such a pain to keep track of.

Anyway ... use a receipt book. It's kind of easy ... amount owed XXX.XX, amount paid xxx.xx, balance due xxx.xx

If they don't pay it in full by a certain time and if you make an agreement for this month such as "pay the rest by the 13th" and you don't get it ... file for the amount that they owe plus any late fees, etc.
