State Specific Question About: FLORIDA (FL)

L&T mutually agree to terminate lease and avoid eviction by signing a simple termination letter. Where by the tenant and landlord mutually agree to terminate lease and state a date where the tenant leaves.

The question I have is, that if something happens like the tenant ends up NOT leaving...can they be considered trespassing and the police be called because I have that in my lease. In other words,, eviction is not necessary

I also want to know if I can accept payment for them to keep staying until they find another place or I find another tenant and NOT have to do an eviction and they don't get a lease either.

I am not familiar with Florida laws. However, in most states you would need to go through regular evictions processes, and the police would not remove them.

You could try cash for keys if you don't want to evict. Otherwise, just go ahead and do a formal eviciton and get it done with. --23.228.xxx.xxx

I have seen where the police would treat a week to week rental similar to motel law and remove someone for not paying rent immediately but there was a catch,the rooming house was owned by a cop and they had a BS excuse why they wouldn't do the same for me at my rooming house. --24.92.xx.xxx

It's your job to enforce your lease.

Not really.

(People sure do draw wild conclusions).

Your lease can go into detail, the more the better. If your lease goes outside of state law it can not be enforced.

The next shadow above you is that collecting rent day to day or week to week can bump you into a rooming house category.

That comes with another set of rules different from regular residential rentals.

Here again, the zoning needs to allow for this.

So you may find yourself stuck into a month to month agreement depending on your county, as well as your state.

Smokey, if this helps...

I keep it simple. When someone says "can you work with me?" They are instantly on my weekly PayDayPlanRent, paid in advance (divide the rent by 4 and add $10, collect over 52 weeks.)

At convention I passed out my Move Our Agreement form which they sign showing a move out date.

It boils down to Pay or Leave.

If you are trying for motel status with weekly or daily, the police will not help.

If the res cannot pay he needs to go, either peacefully right now or thru court.

Reminder: cash for keys is ALWAYS cheaper than court. --67.175.xx.xxx
