I have an applicant who listed that her adult son would be living with her. She's pretty marginal but when we checked the son we discovered that he's a thug with multiple arrests. Can I reject solely based on the criminal background of a tenant in SC? --70.39.xxx.xxx |

I'm sure you have "no felonies" listed on your official, written acceptance criteria.
Felons are not a protected class, at least in SC. That's plenty good cause for rejection.

What gevans said plus tell them you have a lot of applicants to screen so they should keep looking. That avoids a confrontation when they think your place is a sure thing and then you never call.

When I rejected an applicant because one person in their group had a criminal history, I wasn't specific on they type of crime. Why? Because when the person was arrested he was drunk. Having taken a 30 day sober class and haven't had a drink in 30 days, qualifies him as a "special class" and is protected under the law from discrimination.

As far as I know, the only time you cannot reject because of a criminal conviction is if it was a drug use conviction since that is now considered a disability. --68.46.xxx.xxx |
