State Specific Question About: TENNESSEE (TN)

My tenant is in jail for, he says, a false accusation. His wife is mentally challenged and bounces most of the utility payment checks. The husband has given me power of attorney over his VA check so that I can take out the rent and pay the utility bills. Wife also has a check, food stamps and plenty of funds for her needs.

The bank thought I should check to see if there Is a legal issue because I am paying myself the rent? Could the tenant come against me later if he had a change of heart and saw an opportunity for a lawsuit even though he filled out a power of attorney form?

Ask your attorney. Banks don't know anything but they may be right in the fact that you have a conflict of interest ... but what do I know ... I'm not a lawyer. --74.78.xxx.xxx

If the POA were well drafted by an atty, it should have spelled out the authority you have to pay rent to yourself notwithstanding the conflict.

If the conflict is recited and addressed, you can act without fear.

Do you really want to get involved in all that?These kind of tenants love drama and you are getting sucked into it.I think it would be easier and less taxing on your brain to just get rid of them and find more normal tenants --24.92.xx.xxx

i suppose if you upped the rent for them and not other who rent from you... i would just keep the rent the same and keep very good books and records and every penny must be counted for... but yes an arms lenght away would be better,,, doesn't the man have a relative who would help do this for him? Banks provide this service so yes they would have a business reason to tell you what they are telling you. --184.215.xxx.xx
