Our tenants moved out - gave us an address to which we should sent their refund check. We mailed the check to the address that they gave us. They had trouble with the mail box on their end - it didn't have a lock on it - and now they aren't sure if the mail ever got there or if it got there and it was taken by someone else.
The check has not yet been cashed (our account shows it's still pending). We could wait another day or so to see if it shows up but what if it doesn't? Who is then responsible if the check gets cashed by someone else? --97.122.xx.xxx |

Not 100% sure, but I can't imagine anyone else being able to cash their check. The only places I know that cash PERSONAL checks are banks, and they are supposed to check ID. If they don't I'd say the onus falls on the bank.
Did you mail with delivery confirmation and/or certified mail so you have proof of mailing date to show that you fulfilled your state's law regarding proper handing of security deposit? --108.250.xxx.xxx |

If simple math tells you they should have gotten it by now and they told you there's an issue with their mailbox not locking. If it were me I'd call my bank and have them issue a stop payment and then make other arrangements with the tenant. When you say "pending" do you mean that it some how is in the process of being paid by the bank or that it hasn't shown up? --76.2.xx.xxx |

What has the tenant asked for? If they ask for a new check, then put a stop payment on the one you sent, reissue a check and charge them for the stop payment. Tenant's mail problems are not yours.
I have decided today that I'm going to start sending deposits back return receipt required. Got a call from a tenant that was mad about how little money they got back. This was sent back in January. --75.160.xxx.xxx |

This has happened to me several times before. One time my x-tenant lied and tried trick me into sending them a replacement check quickly saying they desperately need the money and they were ready to cash both checks upon receipt of the replacement one. They didn't know I had placed a "stop payment" on the so called lost check.
This taught me a lesson. From now on when a x-tenant says they haven't received they security deposit refund check, I mail them out a copy of the payment check and another copy of the accounting. I also make them wait 30 days to see if the check is found or returned to me. I also request they write me a letter saying they haven't received the check and I can place a stop payment and issue them a new one.

ALWAYS send deposit refunds certified with tracking.
Now you may have to eat a stop payment fee, since tenant can claim you never sent check.

The green card is the return receipt which they sign, this way if they have a bad mailbox the carrier puts on a sticky note to pick up at mailman central. --75.94.xxx.xxx |

I agree with BillS. My lease says tenant pays bank charges, so if I have to pay the bank a stop payment fee on a deposit refund check. I'll include a copy of the original and deduct that cost, refund the difference in this case. Tenant said they have been having trouble with mail box on their end! This happened to me. I moved from one apartment building to another with the same property management company so they had my forwarding address. Their records show they sent me my security deposit check but I have never seen it. Now that I'm requesting a new check, they're telling me it's already been cashed. --69.129.xx.xxx |
