Greg, your lawyer must not just understand real estate but also estate planning/trusts and small business accounting ... he needs to know your insurance coverage. YOU need to figure out what "protections" you want/need ... in other words, why do you want a LLC (or some other type entity)?
Pros is it's cheap up front. Con is when you don't take EVERYTING into consideration, and you have to pay an attorney to attempt to fix what you should have paid for in the first place. --174.55.xxx.xxx |

may I suggest you search on this sight and read all the subjects related to the topic, read a book or two from the library,,, as every lawyer in town will take your money and deliver papers and in the end you won't know what you have, how to operate it and perhaps cause yourself more issues, only to pay another lawyer to figure it out, teach you and undo paperwork.

I no longer use my attorney to set up my new LLC's.
Greg G, you can set up your own LLC by going downtown and paying the $90 fee. I go in at the center door on West Washington Street, go to the center of the building at the East end closest to the Indiana State Capitol building and down the elevator to the bottom floor and the office is right there. Not that I've ever been there many times or anything. They have a standard document that you can fill in to do it if you don't have your own. Easy Peezy. Do you have a name yet? Have you searched to make sure it is available? You can do the search "Online" on the State's website. save you $750 to $1k, but if the attorney is good, you'd probably get a boilerplate, iron clad LLC "Articles of Organization"
If you didn't follow me on all of this, I'd just hire an attorney, he knows where to go and what to do. I won't recommend one. He will know what to write into each fill in the blank. good luck

Great Advice, I like various options and suggestions. My purpose to set up a LLC is protection from my personal assets. I'm getting close to retirement and want business and home finances in two different baskets, the financial part is done. Now for the legal part. From the responses I received, my plan now is to 1)read a few books on LLCs and read more postings. In the mean time look for a lawyer close to my area. 2) Then pay the lawyer to do the first one so I know the process, then I will be able to do them myself. 3) Also on keep up on the legalities of LLCs. This is my first time I used Mr. Landlord. (it won't be the last). Thank You fellow landlords for your input, you made my day. Greg G --75.27.xx.xxx |
