State Specific Question About: GEORGIA (GA)

I don't know anything about GA, but ...

Seems that lease has expired or is due to expire, and you did nothing and let it expire.

Many states make an expired lease automatically turn into a month-to-month tenancy. Is that the case, here? Then tenant probably has go give 30 days notice.

The essential point here is that tenant is entitled not to sign a new lease if he doesn't want to. Negotiations are fine, but nothing beats a signed contract to mean agreement.

You may want to add some language in your lease that if there is no notice more than say 40 days before the end then the lease rolls over for another year. That way you don't have to sign a new to have them on the hook. If you change policies and want them to sign a new one then you can do that but it's not required.

Really you can't make them sign a new lease. You can post notice that they must move if they don't sign a new lease. That's usually what happens unless your lease contains other clauses. --75.160.xxx.xxx

I always include an automatic increase in rent when the lease expires and goes month to month. This usually forces the tenant to accept signing a new lease or an increase in rent to go month to month.

If Tenant shall remain in possession of all or any part of the Premises after the expiration of the term of this Lease, with consent of Owner and without a new Lease being executed, then Resident shall become a lessee from month-to-month subject to all of the applicable covenants, terms and conditions hereof, except the monthly rental payments shall increase by 10%.

WOW they will not like a 10% increase in rent, so they will usually negotiate a lower rent, say 4% increase! --99.132.xxx.xx

If the lease has expired or will expire will out renewal you now have a tenant at will. According to the GA LL Tentant handbook he needs to provide 30 days notice to move.
