State Specific Question About: OREGON (OR)

A few months ago my brother let an appraiser into my rental house after which brother told me he saw their dogs and a cat. I allowed them to have two dogs only. I never brought it to my tenants attention as I had no proof and live out of state.

Shortly after my tenants moved out I discovered a litter box and scratching post at the bottom of the recycle can. I did not get non refundable pet deposits from tenants. Can I take money out of their deposit for housing un-allowed cat(s). --98.202.xxx.xx

i would send them notification that you are aware that they are in violation of the pet agreement by having more pets than agree upon. And how they can cure the problem. They can get rid of the extra animal(s) by certain date or pay non refundable pet deposit. Of course this is what I would do in my state with my lease. Just a reminder about deposits - they are by definition refundable, so there needs to be guidelines to the usage - so make something like this a fee, not returnable. --75.94.xxx.xxx

I had a tenant take me to small claims court for not refunding her full security deposit. She was smart, knows how to present herself and is a knock out. We had a female judge who had the hots for my x-tenant that played this point up and flirted with the judge.

The tenant and the judge were against me for not giving this nice lady her deposit back with pictures showing the place in perfect condition after her move out.

My pictures were different. First picture was of her two cats at move-in day. I keep pictures of all pets for reference. Then my next pictures were of the carpet when it dried out after being professionally shampoo'ed. Spots everywhere.

I had in court my flooring guy and pictures showing him lift up the old carpet with cat stains everywhere. The carpet padding stuck to the wood floor and pee stains on the hardwood flooring that was under the carpets.

The flooring guy testified to the damage and we presented sections of carpet damaged by the cats. We presented sections of the hardwood flooring that had to be replaced due to the cats.

I also had the tenants veterinarian's records that the tenants cats were put on medication due to peeing outside of the litter box. She had disposed of them in the trash bins and I removed them before trash pickup.

I barely won my case. Didn't have to refund the security deposit. But I couldn't collect the actual cost to replace the damaged hardwood floor. Judge ruled that I had a deposit and that was the extend of the tenant liability. I showed the judge code that liability doesn't stop at a deposit because there are limits to what a landlord can charge a tenant for pets. Judge said I run that risk when I rent to people with pets. --98.119.x.xxx

Check your state law. Most states restrict use of security deposit to reimbursement for unpaid rent, damage to premises and cleaning after tenant leaves. Other deductions are not allowed.

At a minimum, to charge a fee you must have agreement of the tenant. Chattering fees is in general a practice disfavored by courts,

Charge them for the "funny smell". It's likely something they used to mask the smell of cat pee. Find the source (where they urinated) remove it and repair. Any other approach will leave the house with the smell of cat urine on days of high humidity. --75.160.xxx.xxx

Once had tenants moved out, carpet completely trashed. Pictures taken during the removal of the carpet showed multiple urine stains. Pad stuck to the floor, etc...

The tenants swore up and down that their dogs (second dog unauthorized) did not urinate on the carpet. My response was "Well, if your dogs didn't do it, then I guess you must have peed on the carpet. Doesn't matter who did it. I still have to charge for it." The look on his face was priceless. Never heard another word. --205.223.xxx.xx
