State Specific Question About: NEW JERSEY (NJ)

I am a landlord, i signed residential apt lease. Lease is over.Tenant moved out.. Tenant did not pay some rent, the security deposit (when taking damages into the account) does not cover all the expenses. Can I put an entry into the tenant credit report? Thanks! --50.14.xxx.xx

Who are you? Bill Gates? NO! A landlord can only report negative information onto a tenants credit report once they have obtained a Court Judgment or Court Ordered Eviction. And then it's still a process. --98.119.x.xxx

Actually Leon, Robert is not correct. YES, you can report a tenant's debt onto their credit report, and you do not have to obtained a judgment. In fact, you can do so right thru one of the sponsoring services on this site for a very low fee.

You can do it right on line and it only takes a few minutes. Click the "Services" link above and scroll down to the Report Debts service or simply go directly to the following URL -

Indeed -- Robert is incorrect and you certainly can do it.

Be aware, however, that if they submit something to the credit bureau(s) stating that it is in error, then you will need to be able to back it up. And it is MUCH easier to do that once you have that judgement. So, in my opinion, you should still pursue that judgement in small claims. You'll want to have it eventually.

Leon, did you send a final accounting statement to the departing resident stating the outstanding amount still due? If not, you should. Your former resident may square up with you. Only one time have I ever kept any of a resident's deposit. The damages came to $1,000. over the security deposit. I sent the detailed accounting statement showing the balance owed of $1,000. and received a check for same shortly thereafter. --172.56.xx.xxx
