State Specific Question About: TEXAS (TX)
Hello
I have been renting my home to a family for abput 4 years. All these years we treated each other good. For personal reasons I need to put my home in the market for sale so, I told the tenant my decision. He said that he will need a couple of months to move out.
The lease expired the first year and we never signed a new one.
What steps should I follow to avoid any risk to get my property back? I'm new in this landlord business.

I don't know TX law but, in most states, the lease would have converted to a month-to-month after that first year. Therefore, you'd just need to give proper (written) notice that you are terminating their tenancy. (Probably 30 days.)
Hopefully someone in TX can give more specifics for your state.
That being said, if I had a good 4+ year tenant and I simply wanted to put it up for sale -- and they asked for two months instead of the standard one -- then I'd probably say "no problem" and just have them sign something agreeing to terminate the tenancy and be out by such-and-such date. Keep everyone happy that way. And we're only talking an extra month, right?

There are no steps that will allow you to avoid any risk.
But what I would do is put things in writing. Give the tenant the agreed up move-out date in writing. Set forth a move-out check-list in writing and ssend it to the tenant at lest 30 days before the move-out. Let him know in advance things you expect, such as professional carpet cleaning, all light bulbs (and functioning) in all light fixtures, all appliances clean and in good condition, all window treatments ...
Arrange a pre-move-out inspection about a week before the move-out date, so that you can point out problems that the T will need to address.
Of course, the Tenant can tell you to go stuff it, but if you have a good relationship, well, ...

if the lease has expired and you didn't have a new written one in place then they are on a verbal month to month and you need to give at least 30 days written notice of non renewal of lease/please move letter.
Any time after the date in the legally posted notice, tenants that didn't move would be in considered hold over and they could be responsible for up to 3 times daily rent. Be sure to add that into the non renewal of lease letter. --23.123.xxx.xx |
