State Specific Question About: FLORIDA (FL)

I have never done a garnishment before. I have a judgment for an evicted tenant that I evicted in Oct 13 for $9100.00. Due to family situation I have been unable to address the issue until now. I had planned to turn over to a collection agency, but now having second thoughts. I know where they live. They have no money, but he does/did work and I think he still does. It will cost me close to $200.00 for a wage garnishment. Couple of questions. Once a judgment is awarded, can a Writ be denied? I hate to throw good money away on bad! And two, if a Writ is obtained and they quit their job, does the Writ go to the next job or do I need to pay $200.00 to file each time they change jobs? This eviction was a two part hearing. Part One Possession/Part Two Damages. They failed to show for Part Two. Then stated to me after the fact when they got their "Nasty Gram" collection/report to credit from this site, that they were never notified. They were, I sent certified, showed the "sealed/returned letter" to the judge who issued the judgment! Anyway, I just don't want to throw away good money on bad if I have to re-file if they quit their present job! --74.4.xx.xx

In my area if I had that judgment for that long it could not be denied but they can go bankrupt to get rid of it.It costs me about $100 to start collecting,but if they quit and go work somewhere else it woud cost me the $100 again and I would have to do the paperwork again assuming I find out where they work.Call your sheriffs office and find out the procedure,it may not be too bad,I am able to get 10% of there paycheck as long as someone else is not already collecting from them.For that much money I would be attempting to collect. --24.92.xx.xxx

Something else you might want to check into. Thanks to Gail (MO) on this site he informed me that I can not only garnish his wages but I can garnish his vehicles. There are some stipulations I have to follow but I am looking into doing that on a tenant I got judgment on near the end of January 2014.

I ask my circuit clerk about this and she didn’t know anything about doing garnishments on vehicles. She checked with the state and found out that indeed I can do that. I called sheriff to see about garnishing his vehicles and sheriff said it couldn’t be done. Around and around we go. Finally I got everyone on board and they all agree it can be done. Rapidly moving forward at the government snail pace.

Check and see if your state allows garnishment on vehicles, boats, jewelry, and household property and so on. If MO allows it maybe FL will also.

PS Does anyone else in other states know about garnishing stuff besides wages.

From what I have read, you can garnish vehicles. But when I did a cost analysis, not really worth it. A lot of $ upfront to seize it, pay for procedures, etc. The vehicle they own is not bad, not bad indeed. But after cost of procedures, I would be left with maybe nickels and dimes at best! And that is depending on if they have another vehicle to get back/forth to work! But, I like your thinking... :)

Here we block the license plate renewal, but the loophole is they sell to spouse or sister and replate the car - when they get another you do it again and the cycle repeats, it even works out of state if the car plate originated here but only once - when it is sold it is off the radar for good. --75.94.xxx.xxx

The $200.00 is for the wage garnishment. 103.00 for attorney fees and $85.00 for clerk filing fees all paid to the court house and that just gets the ball rolling for wage garnishment. For the vehicle, it has been a few months since I read up on it, but I have to pay a fee to the DMV, forgot how much, then to the Sheriff/tow truck to seize the vehicle. Then it has to be put up for auction through the Sheriff's Office. When I subtract my costs, the value that the vehicle could likely receive, I would probably be in the hole as far as receiving any monies. :( --74.4.xx.xx

Sometimes it is one of those principle things. I have vowed to take each and every one of my deadbeats to SCC even if it cost me a little money. Why? I want the word to get around that you don’t skip out on me. Being a smaller town (15K) it won’t take long. Have a friend here that also takes everyone to SCC. He has over 200 rentals. We both think the same way. As for the vehicle. If it doesn’t sell well at the sheriff sale, say no one bids on it, then you or your relative bids $50 or whatever and then you go and sells the car. I understand it is a little work but after a dozen or so you might get to like that kind of work.

Life is too short, to waste time and additional monies, to send a message on a fruitless endeavor

Speaking in general terms, tenant becomes unemployed, has no assets, becomes disable, etc. i.e. Judgment proof, why should I waste additional monies and my time to send a message. I rather spend my spare time on things, projects, hobbies that simply improve my quality of life,

I was not aware throwing good monies after bad and wasting one time on a futile venture was a prudent business decision , vs. a purely emotional viewpoint

Here, the forms for a wage garnishment are very easy to complete. Ask the court clerk for the forms and you can probably figure out how to fill it out without an attorney. Then, you will only have to pay $85 to do the wage garnishment. If they are working a decent job, it may only take a couple weeks for you to recover the fees. --68.46.xxx.xxx

Well, I did get the judgment to send the msg! But it was my understanding I had to pay both the $103.00 and the $85.00. Maybe I misunderstood. I am sure I can fill out the forms myself. But I was under the impression that both fees "had" to be paid! Bank accts are a "no go"! I am not going to bother as these are not high end renters or a high end rental. She was a tenant for a good 5-6 yrs and a good one at that until the end. :( Then she turned south when they lost their jobs, as many have in these times... I will double check the costs though. If the tenant disappears on you - that you don't know where he works and don't want to throw good money after bad money ---- send him a 1099 about his rent to the last known address (the irs considers past due rent income to the tenant) after sending a 1099 you can no longer collect it, but his return will be audited by a more powerful foe. check here for more 1099 info. --74.202.xxx.xxx
