State Specific Question About: OHIO (OH)

i am evicting a tenant and i text her to let her know we were coming in the house to check to make sure everything is safely secure. i did not put a written notice on the door because she is not living there but have left some items in the house.if i had put it on the door she would not have receive it so i texted her.so can i do that and call it an emergency visit. i don't know if the heat is off, water running ect. --208.54.xx.xxx

As usual.. always personally check your statutes many of the questions asked here are very specific to a State or county/city statute..

For yours.. of course check OH statutes..

Many states require a posted notice.. and then so many hours before you can enter..

Also some states allow 'post & mail' notice and many I check don't specificity say yes or no to a text or even email being allowed or not.. so the state may be silent on the matter.

Your concern of course is the property safe, and secure and nothing is 'running' is a reasonable one, as you know she is gone...

Check OH law regarding entry by landlord to see if method of giving notice is specified.

also she said it was mold in the house, but i have tried several times to make an appointment to come over there and check it out, with no response. i would think that is an emergency, so when we went by the house didnt take a key because i thought she was still there, that's when i found out the house is empty with only a few things left, her eviction was last week but her lawyer called and said he couldn't make it. --208.54.xx.xxx

Sorry but you need to post the notice, many courts I visit say texting is useless, about the same as email, it is nice to follow up on repairs but not legal to initiate, her lawyer does not have control of the court - you hired them. I would ask for default judgement, get the writ and move along, change locks after the house has been empty out or abandon - cleared with police. --75.94.xxx.xxx
