State Specific Question About: MISSOURI (MO)

Have a tenant who has violated my lease by moving an unauthorized person into my unit. My lease says that I can give a 10 day notice for a breach of any provision of the lease.

I called an attorney who told me that I should give a 30 day notice because it was required by the Missouri unlawful detainer law unless the tenant is involved in drugs or some other serious matter. I have another attorney, who tells me no, 10 day notice is sufficient.

The MO law says that you can give 10 day notice, but then mentions drug issues. It appears to be silent on whether a 10 day notice for a breach of a term of the lease is sufficient. I don't see a 30 day requirement anywhere, except for the notice required to end a month to month lease. Again, my lease says I can give 10 days.

Any thoughts on type of notice I should give?

i would give them according to your lease, 10 days to correct the problem or move, if they don't correct the problem or move then I would at that point give them a 30 day notice from a rent paying date, other's from Missouri will come along and write more. --184.239.xxx.xxx
