State Specific Question About: MONTANA (MT) I have been reviewing the landlord-tenant law for the state for an answer, but like the "milk in the refrigerator", I cannot seem to find any reference yet. Does anyone know if Montana allows the "discounted/gross rent" clause like Mr.Landlord suggests in his Survival Guide. I think it is a brilliant solution to late fees, but I do not want to incorporate it in my lease if it is frowned upon by that state's courts. Thank you in advance!

Here is what I use in Fl, don't know about Montana. I have never been questioned about it, and note the resident has to perform a certain task (deposit to designated bank account within announced time frame ) to get the discount.

2. RENTS: Rent of will be paid in advance by the day of each month. Rent not paid by the first day of the month shall be assessed a $5.00 per day late fee until all rent is paid in full. A $25.00 charge, or 5% of the check amount, whichever is greater, will be made for checks returned for any reason, plus applicable late charges. Any payment tendered shall apply first to non-rent items, including late fees, repairs, penalties, appliance rental, and other amounts due Landlord, then to unpaid rent. Should remainder be insufficient for rent due, all additional late penalties shall apply. Landlord may require payments be made by cash, money order or cashier's check and shall give a minimum of 30 days notice of any rent changes. All rent shall be paid to the bank and account number designated by landlord. Additionally, residents shall be responsible for any city imposed user fees on property. This includes Solid-Waste (garbage collection) and Storm Water Runoff Usage fees.

3. A discount in the amount of _____$50________ may be deducted from the rent each month if the resident deposits the rent in landlord’s designated account BEFORE THE FIRST DAY OF EACH MONTH.
