Hello everyone,

A tenant has asked me if I have a problem with her keeping one child in her home to earn extra income.

Though I'd like to accommodate her, I am afraid I would be exposing myself to liability by doing so.

Any thoughts on this based on your experiences?

My lawyer put a clause in my lease specifically stating no for profit daycare. This has come up for discussion in my local landlord group and we have been advised against it. My notes mention insurance coverage issues, trip & fall, mold, etc. --75.67.xx.xx

In CA you have to allow it even if your rental agreement/lease states that it's to be used as a residence only. They are required to do certain things like be licensed, but what's the point in being a private property owner, property you paid for yourself without help from the government, only for the government to tell you what you can and can't do with it. --71.177.xx.xx

Oh my! That's scary to think that I may have no choice in the matter since it will most likely expose me to additional liability, increase my water bill (which I pay) and increase the wear and tear on the place.

I'll try to find out about SC law covering that.

V: I assume that is for people LIVING there. People doing child care for a business do not count as living there and therefore wouldn't be impacted by a lease clause stating that extra people are $50/each.

(On a side note, that clause is likely illegal for children anyhow -- in case they actually brought another one in. Charging more based on the number of children is likely a discrimination issue. But, again, that's a side issue that doesn't even apply here.)
