State Specific Question About: ILLINOIS (IL)

Hi every one, I am going to eviction court on Monday my first one. I have been a LL for six years. I have an attorney that will be there. My question is there is an unmarred couple in the house with one child between them and one child that is hers. They served him at work but have not been able to serve her. Will I have a problem at court since they could not serve her? --98.227.xx.xxx

Great question for you attorney !!

Usually your rental agreement will list all the tenants and that they are

'jointly and severely' responsible

So in some states, and dependent on your agreement service on one would be service to both

Eviction only or eviction plus money judgement?

In MY state, you can only get a money judgement if they were personally served. But I'd have no problem with the eviction itself proceeding even if it was only mailed to her and/or posted.

Well went to court today and it did not go as I hoped. I put over $5k in the house before they moved in. They filled out a walk though form and all they could come up with was there was bugs in the outside light. They told the judge that the house was in disrepair and I agreed for him to fix it for rent owed. (Lie) Then says the house is full of mold, mice and rats. (Lie) The judge said when do you want them out and I said right away. Then the tenant starts winning about no money and they don't have anywhere to go (they make $4,400 a month). He also said his wife just had surgery and could not walk and he has a 5 year old so the judge says he will give them a week. The tenant did not like that so he said he wants a trial. Now next Tuesday we have to go to trial. --98.227.xx.xxx

I shouldn't be surprised at what people do, but it's still hard for me to believe the lengths some of these folks go to. Their lies and scheming has to catch up with them sometime. --71.177.xx.xx

My judges typically give one week for the tenant to get out after the hearing. I have never had a tenant ask for a jury trial, I believe they are required to pay a fee for that. Good luck, and let us know how it turns out. --68.46.xxx.xxx

Carol, thanks for the support. I am just chalking it up to a learning experience. Kyle, they both get paid every two weeks so I think he just doing anything not to have to move before pay day. --98.227.xx.xxx
