I supplied our tenant with the mandatory "lead paint disclosure" but they want me to have the paint tested for lead at my expense. Is this a reasonable request from the tenant? What is my legal responsibility as the landlord? --174.25.xx.xx

The landlord is not required to test for lead paint or remove it.

If this tenant is still a prospect, I wouldn't rent to them.

Actually the lead test is pretty inexpensive. maybe $500 for a pro to do it and write up a report. BUT then what? If no lead, thats great. No more worrying about lead. HOWEVER, if there is, then you know and have to notify all future tenants that it exists.

Most insurance has a lead paint exclusion. So you are on your own if sued. --108.54.xxx.xxx

If you read the "Lead Paint Manuel" it talks about contact surfaces, such as wooden French Windows, doors and cabinets. If you have wood contact surfaces that touch and rub the paint off, you can buy a cheep lead test kit from Home Depot, called Lead Check. This is not legal in California. If you re-painted over every surface then the lean is below the surface and the tenant is protected.

Test the dust caused by contacts and see if the small particles have lead.

You are just following the law by providing that information. Disclosing that it is possible (possible, not probable, not absolute etc) that paint used prior to 1978 MAY have contained lead. But as you can see Potential Tenant, IF there was lead paint (2-3 paint jobs ago), it is no longer present to the atmosphere.

I don't think you have to explain Lead Paint to potential tenants. you can see by my post that I am having a hard time explaining. Don't eat paint chips. Don't leave child unattended to eat paint chips.

If they are adamant about "testing," I would see that as a red flag. --68.37.xxx.xxx

IF YOU TEST FOR LEAD AND THEN FIND OUT WHAT IT COSTS TO GET RID OF IT AND YOU DO NOT PAY, YOU MUST DISCLOSE THIS TO ANY AND ALL FUTURE BUYERS AND ANY FUTURE TENANTS THAT YOU TESTED AND FOUND LEAD PAINT AND DID NOTHING!

I would suggest to the prospective tenants that if they want the confidence of knowing that there is no lead paint then they should seek a newer building. I would let them out of any leases immediately and refund all money if it is left rent ready. And then point out how your painted surfaces are properly maintained. --64.222.xxx.xxx

Lead paint disclosure is mandatory and required by law to be disclosed if the house is built before 1978. But I would not test it because they requested it. Either tell them they could find another place or they can have it tested themselves. --76.122.xx.xx

Roy (AL) - as Roy (FL) stated, it's Federal Law you must disclose. There is a form and you must use it or you are in violation of federal law. It applies to both rentals and sales. Not everyone knows so lots of tenants haven't seen it or haven't rented in older homes.

You must disclose that the house may have lead paint and that you haven't tested for it. Again it's federal law. --75.160.xxx.xxx

Q--- Your advice is bad. Give the tenant the booklet and that is it. You are not an expert and spouting off about how even if there is lead paint it is safe because it's painted over can only get you in trouble. Tell them there are no reports or info. (If that is the case), give them the booklet, and ZIPIT.

Become smoother than this. In my app it states that they receive the pamphlet. Then in my lease they sign the disclosure and never give the pamphlet unless asked. Hear no evil, see no evil, speak no evil.

In other words, keep your mouth shut. If they demand testing, simply refuse, show them the rented it as-is, like it says in your lease right? Then offer them an option to leave of they deem it necessary. I won't be held captive by an idiot tenant. --66.33.xxx.xxx
