State Specific Question About: DELAWARE (DE)
I have a judgement against a tenant I evicted 1.5 years ago. I attached her wages but shortly after, she stopped working at that company. For the past year I have been trying to collect through the court but she has moved several times. She is now filing bankruptcy and I am to attend a meeting of creditors next week but will be out of the country. I contacted the Trustee, the court and nobody will tell me if I can send someone in my place or what will happen if I don't go to the hearing. The debt is $6500 so I do not want to miss my chance at getting it back. I need to know what rights I have now that she filed bankruptcy and what I can do about not being able to attend the meeting of creditors. --167.112.xxx.x |

it probably doesn't matter whether or not you show up.
Did she file chapter 7 or 13? if it's 13, you will get your money paid back over a 5 year period. if it's 7, unless you can prove some type fraud, you're probably out of luck.
Personally, I would pay an attorney for advice just so I was sure I was covering all my bases.

You will probably not be prejudiced by not attending, but I would send a representative. Even if just to write down what happens and to report to you.

Katie,
Look for a form you can fill out stating your claim against them. ALWAYS file that.
We just got a small check from the BK court as our part of their BK.
Sometimes, judges do not let them off the hook. Rare, but it can happen.
