State Specific Question About: MARYLAND (MD)

I had to evict my tenant mid Dec for non payment in Oct Nov. Does she owe me for a full or half months rent in Dec? --98.233.xxx.xxx

usually, when filing eviction for non-payment of rent, the rent stops accruing on the eviction date. Has the tenant vacated yet? Are there any funds to work with?

Tenant is out. As for funds, not sure if you mean tenant's or mine. What about late fee for the month in which she was evicted or some portion of it, or is that month (or partial month) on non payment now given a different status. Thanks for your reply. --98.233.xxx.xxx

funds : tenant deposit. Or if you get a judgement, funds that can be garnished from the tenant(job or bank account)

late fee: yes, I would charge late fee (per lease) for Oct, Nov, Dec.

In Missouri, she'd owe for the entire month if she hadn't moved out by Dec 1st.

Do they have any money? If not, your question is irrelevant since--as the old saying goes--you cannot squeeze blood from a turnip, no matter how much blood you're owed: 1 month, 2 months, 3 month, etc. Broke is broke.

When a tenant owes me rent and fails to communicate a good reason, I give them a call on the phone as a first attempt to resolve issues. Then I serve them with my State's proper legal notice to "Pay Rent or Quit". In that form it says how much rent I'm seeking. Example, last months rent (or part)and this months rent.

Then in court if I win my case my attorney will amend the complaint to include rent owed as of the court date.

After the tenant has been ejected by the Sheriff, again my attorney coverts the eviction to a "money Judgement" and asks for additional rent owed.

Trying to collect is like milking a cow with your hands tied behind your back -- almost never happens. --98.119.x.xxx

Because of poor communication skills, I do not know when/how tenant vacated. If LL served a __ Day Notice To Pay Rent Or Quit, and Tenant vacated in accordance with that notice, I would argue that the T's rental obligation terminated on the day that T moved out.

If T remained in possession until the Court issued an order or judgment in an unlawful datainer action, again, the rent would be due only until the T moved out. Although if monetary damages were assessed by the Court, that amount of rent owed should have been determined by the Court.
