State Specific Question About: OHIO (OH)

I have a property that tenents stopped paying me over a month ago. I gave them notice to leave then they gave me a 30 day notice that they would be moving at the end of the month. I let it slild and they moved but left tons of things behind. Its been over a 2 weeks and they keep asking for more time to get the things. The electric got changed to my name and water is off. I am sure they are not living at the house anymore beds are gone, TV's gone, couch gone and nobody is ever at the house and they gave me forwarding address. Do I still have to evict them to get the stuff out? I have a clause in my lease that has something about abandoning property and they only have 48 hours to get things. I told them I would move things to exterior garage and give them or time so I could get house cleaned up and she said she would call her atterney if I touched her stuff --71.53.xx.xx

Check your local laws to see if they define abandonment. In my area, them contacting me and asking for time to move things would mean they had not abandoned their property. Do they still have the keys? I think I would give them notice that they have 24 hours to finish moving or you will file eviction and follow through with that. They are moving slowly because you are allowing them to. You may want to talk with a local attorney to see how the courts handle abandonment in your area. --68.46.xxx.xxx

I do not OH LL/ T laws but in OK we have to inventory property and then put in storage at their expense. Then send them a letter that they have so much time to retrieve their belongs and send it certified mail w/ returned receipt requested and go from there. --72.198.xx.xx

As some new landlords discover, those lease clauses can be bad for business going thru court, OH is mostly a 30 day state so now would be good to get keys and switch locks - move things to front porch and tarp so you can get started on the repair work, be sure to get daytime photos of damages and send the accounting statement certified mail within 30 days even if no new address is known just send to last known address and let the post office forward or return to you in the event of court - you do not open this when returned. --75.94.xxx.xxx

After talking with a lawyer I needed to evict because they didn't give me the key. Kind good news I told the tentent if she didn't let me move her stuff to external garage and give me keys tonight I would evict so she agreed. She basically did nothing and I and helpers moved tones of property to garage. I told her I would give her 2 weeks to get rid of that. I changed locks and now u can start repairs. No eviction needed now! --71.53.xx.xx
