They will probably award possession at the hearing. The landlord does not have to keep your things for you. They will either be put outside or put into private storage and inaccessible to you until you pay the money you owe. If you do not have a new home lined up yet, you should get a storage space. Many are available for only a few dollars to move in. The sooner you get moved out and return the keys to your landlord, the better this will work out for you. --68.46.xxx.xxx

In my court, the judge has the authority to order the resident out that day.

My advice: you know it's coming so

-call your LL and work out a move out date you can both live with, like 2-3 days.

-rent a storage unit and start moving your stuff

-call some friends and ask for a couch to crash on. If you cannot afford your own place, look to become a roommate and pay partial rent.

-when you DO go to court, best to say "I'm already out and turned in the keys."

-ask for a loan from parents etc to pay off your debt. This will show on your credit report and dog you until it's paid.

The sheriff usually will not give the exact date but may give a range or the week they plan to do the eviction (this is for their own protection so someone will not be waiting /w a shotgun behind the door). Your stuff will be placed on a public roadside. They will not carry out the eviction if it is raining, snowing or sleeting. You can get your stuff from the roadside but a lot of other people stop to get it too even though it does not belong to them. It is best to talk to emergency/social services and they will help you with a truck rental and 1st month's storage. If they won't/can't help, talk to every other service agency in your area and ask for one thing from each. The landlord usually does not store your stuff in an average eviction nor are they required to. In some evictions the landlord may go through the court to seize your possessions and sell them to pay toward your debt but it is more of a hassle so most do not. The best thing is to get on it right away and don't bury your head in the sand like an ostrich. Check with your county to see how to get referred to a shelter. Once you get a bed at the shelter ask to get a case manager. If you are homeless for six months then you become eligible for several housing programs. If you are staying on a person's couch you are not considered homeless by federal guidelines. There is a light an the end of the tunnel if you go to a shelter. --108.51.xx.x

You are responsible for your things, just move and help yourself move forward. Move in with family or friends. Get it together and try again. Sell your stuff on Craiglist if you have too.

On this site every jurisdiction has a different time limit how long one has to keep the furniture and belongings once the locks are changed on the door. One needs to check with the state or provincial law regarding any time period after the sheriff arrives. In Ontario it is 72 hours then after that every thing can be sold, given to charities or disposed of. Try to find somewhere to store belongings rather then wait for the last moment when things happen. Try to contact any agencies which can help. Evictions for the rental housing providers is something we don't enjoy. Unfortunately we have to pay bills. In a difficult economy where the only new jobs are low paying part time jobs it is difficult to find renters as well. This year and last year was very difficult had to cut costs to pay the bills. Which meant considerable adjustments like not eating out as often, buying less for myself along with trying to maintain rental apartment buildings. Remember when was laid off where the bills kept coming in. --74.220.xxx.xxx
