I have a tenant who wants me to hold his check for 2 1/2

weeks so he can do his Christmas shopping. A few months ago this same guy asked me to not deposit his rent for a week so he could buy something nice for his girlfriend for her birthday and I obliged but now I feel like he's taking advantage. I'm thinking of telling him I'll only hold it for 1 week. What would you do? Any Advice?

This tenant is not taking advantage of you. You trained him in what was acceptable behavior, so now he's just reacting predictably according to the training he has received.

Hold it while you go to the bank and apply it to your account, have him go to the bank and ask them to hold the next one while you apply it to your account the same way - break the cycle or the judge will simply give the tenant extra months when you try to evict for what has been normal sloppy business methods. --75.94.xxx.xxx

People can only take advantage of you if you let them!

When I purchased my largest apartment complex, I had the old owners introduce me as their new "manager". So long as the tenants thought I was the manager and I had no power to accept late rents or make costly upgrades, rent was always paid by the 1st of the month and I was never asked for an apartment up-grade.

This all changed when a tenant looked up who owned the property and she found out I was the new owner. Word spread fast and everyone tried to get something for nothing. Either it was new carpet, an apartment re-painted, extra parking or waive late fee's. As I allowed some of the to walk all over me, I learned I had to make a stand and put my foot down, learn to say "no" -- and be prepared to evict at the drop of a hat. --98.119.x.xxx

My tenant called to say not to cash the check and wanted immediate confirmation in writing that we were not cashing the check on a Sunday. She called screaming today saying what is going on that her bank account had been hacked and she has no money. I had already sent my lawyer the request to have her vacate as she is on a 30 day lease and was one month late already.

What obligation do I have to not cash the check she gave me? I need to pay the mortgage.

I would probably say something to the effect of..."when the bank starts holding my checks so I can xmas shop and buy nice things for my wife, THEN I'll start letting you do the same thing. In the meantime, let's keep it professional...provide me the rent when it's due." Had the same issue - and went and deposited the check. Tenant then smashed windows - clearly from the i n s i d e. That's why I would humor him on this occasion and never ever agree to something like this again.

Post-dated checks are also a bad idea - the guy just stopped them all!

This tenant has it the wrong way around. Pay all bills and IF you can afford to buy gifts, go ahead. If nor, there are many gifts which will delight a gf which are almost free. --180.183.xxx.xx
