Holding a Tenant's Check (by curious [FL]) Posted on: Dec 2, 2013 3:36 PM
Message:

I have a tenant who wants me to hold his check for 2 1/2

weeks so he can do his Christmas shopping. A few months ago this same guy asked me to not deposit his rent for a week so he could buy something nice for his girlfriend for her birthday and I obliged but now I feel like he's taking advantage. I'm thinking of telling him I'll only hold it for 1 week. What would you do? Any Advice?

I would go to the bank and cash it assuming it was due on the first, then call him and tell him to do his Christmas shopping in 2 1/2 weeks. --24.92.xx.xxx

I just had a tenant beg me to deposit their check asap rather than holding onto it for a week or two. It makes their checkbook unbalanced! --108.226.xx.xxx

seriously?

GEESH!

Let K-Mart hold the stuff for 2 weeks via layaway so he can some place to live.

Who is this guy...Wimpy's long lost cousin [from the Popeye cartoons?]

"Sir, I will gladly pay you Tuesday for a hamburger today" was his catch phrase. --70.91.xx.xxx

This tenant is not taking advantage of you. You trained him in what was acceptable behavior, so now he's just reacting predictably according to the training he has received.

Like water and electricity, tenant's will take the path of least resistance to solve their cash flow problems. Right now, YOU are the path of least resistance. --108.250.xxx.xxx

Tell him that after the rent is paid, the next money he receives should be used to buy food for himself. --67.213.xx.xxx

Hold it while you go to the bank and apply it to your account, have him go to the bank and ask them to hold the next one while you apply it to your account the same way - break the cycle or the judge will simply give the tenant extra months when you try to evict for what has been normal sloppy business methods. --75.94.xxx.xxx

Stop the insanity. Train the tenant before they train you. One of our tenants grandmother passed away and that's why rent was late.

Sorry for your loss, please add $xxx late fees to you rent.

Nipped it in the bud. --96.31.xxx.xxx

What would you do if the tenant said, "I will have the rent to you on Dec.18 because I have to buy Christmas presents"? It is the same effective question, just worded differently. I might hold a check for a day or two, but a week would incur late fees and a 5-day notice. --50.141.xxx.xxx

People can only take advantage of you if you let them!

When I purchased my largest apartment complex, I had the old owners introduce me as their new "manager". So long as the tenants thought I was the manager and I had no power to accept late rents or make costly upgrades, rent was always paid by the 1st of the month and I was never asked for an apartment up-grade.

This all changed when a tenant looked up who owned the property and she found out I was the new owner. Word spread fast and everyone tried to get something for nothing. Either it was new carpet, an apartment re-painted, extra parking or waive late fee's. As I allowed some of the to walk all over me, I learned I had to make a stand and put my foot down, learn to say "no" -- and be prepared to evict at the drop of a hat. --98.119.x.xxx

We would not let our tenants dictate to us when to cash to cash their rent payments. If they cannot pay you first to insure a place to live over the holidays, they do not to be living there. You are the BOSS, you need to be payed first, not last. --72.198.xx.xx

My tenant called to say not to cash the check and wanted immediate confirmation in writing that we were not cashing the check on a Sunday. She called screaming today saying what is going on that her bank account had been hacked and she has no money. I had already sent my lawyer the request to have her vacate as she is on a 30 day lease and was one month late already.

What obligation do I have to not cash the check she gave me? I need to pay the mortgage.

I would probably say something to the effect of..."when the bank starts holding my checks so I can xmas shop and buy nice things for my wife, THEN I'll start letting you do the same thing. In the meantime, let's keep it professional...provide me the rent when it's due." I'm never a jerk when I have to put tenants in their place, but I do it firmly and with a smile on my face at some point in the discussion. --173.23.xx.xxx

It seems just around the holidays this always happens and know they are coming and having 11 to 12 to prepare for them. We told our tenants if they like to have a place to live for the holidays they best pay the rent first . --72.198.xx.xx

Had the same issue - and went and deposited the check. Tenant then smashed windows - clearly from the i n s i d e. That's why I would humor him on this occasion and never ever agree to something like this again.

Post-dated checks are also a bad idea - the guy just stopped them all!

This tenant has it the wrong way around. Pay all bills and IF you can afford to buy gifts, go ahead. If nor, there are many gifts which will delight a gf which are almost free. --180.183.xxx.xx

We would give him a five day notice and if he did not pay his rent after five days were up, then we start eviction process . But it maybe different in CA. --72.198.xx.xx
