State Specific Question About: FLORIDA (FL)

The law in the state of Florida states that Landlords must provide a safe home for their tenant. This includes treating and eliminating bed bugs when bed or reported to the property manager or the landlord. It is clear that the landlord must pay for the services of the exterminating company but is this the only expense the landlord is obligated to inquire?

Our tenant moved into the unit 30 day ago and to the best of the knowledge of our management company the unit was free of bed bugs. When we requested an estimate from an national pest control company we were informed that the bed bug eggs can live up to a year in a unit and in some cases only bit certain people and not others. The inspector also said that the tenant could have had the dead bugs in his beds or sofa when he moved in. As you can see it is not ease or almost impossible to assign liability to the tenant or the landlord for the dead bug problem. To treat the unit the pest control company requests that the tenant through away tow 2 sofas, and 2 mattress. In addition to this cost the tenant or Landlord must buy a mattress cover to be used for no less than a year at a cost of $160.If you were in our situation in addition to the extermination costs what tenants expenses would you pay?

does the tenant have renter's insurance?

I'm not in Florida, but after the tenant got rid of the requested items, I'd spray or do whatever to the unit/building. If you must by the mattress cover, then do so. I would think the furniture is on the tenant and their insurance. It's just something that happened to THEM not to your other XX of tenants. Your management company did what they do for all other move in's, they acted responsible and responded quickly.

ARe bed bugs dangerous - like fire or water? Can they kill you? Not sure how the make a place "unsafe" ... can you trip over them! LOL! just kidding... i'm sure others will come along with helpful information --70.13.xxx.xx

Sorry to hear about the bug infestation.

I just did a Google search on polyurethane mattress covers (a recommended material) and found several at usbedbugs.com for around $80 for a king or queen size: strong material, bite-proof, non-sweat generating, very nice cover.

If you can cover the mattress and starve the bugs, is there a need to throw away those 2 mattresses?

Methinks you can shop around and save some $$$ on other things besides just this. --108.250.xxx.xxx

The problem with your approach is right here "national pest control company". Ditch this expensive franchise and find a small local company that specializes in bedbugs (think small ad). You will get a much different approach which will be less costly for you and your tenant. Bigger isn't always better. --75.160.xxx.xxx

Just to ask, are you certain the state law puts this on you? Have you read that law yourself?

or are you working from word on the street or from the bug company?

Bill, Brad,Sid,and PatyK and others that read my question:

Thanks for taking the time to answer my question about Bed Bugs. Yes I read the Florida law from the Florida Bar and even though Bed Bugs do not fly or cause diseases landlords in Fl must fumigate for this bug. The problem is not solved in one treatment since the eggs of this bug may be in the wall for several months so we entered into a one year contract with an exterminating company by the name of Turly Nolen. After the first treatment they come out on the 6th day for a new treatment and retrun as many time as necessary until the problem is solved. They do recommend to buy a bed bug protection bag for the new mattress. I hope this helps other who may read this post. --99.61.xx.xx

We manage an apartment complex in Virginia. Two different tenants (they got together and talked) sued me personnally and the owner of the complex. Went to court and discovered they are sueing over bedbugs. First time we are hearing this complaint. Tenant has not notified us of this situation or given us a chance to address. They moved out without paying rent claiming the apt was infested. Asking for $8000. What?!?!?! What is my defense?

Can they sue me personally? I am just an employee but I do sign the leases but on behalf of the owning company. Maybe I am the inferred authority. Anyway, what is the worst case scenario for me and the apartment company? --65.222.xxx.xx

I just purchased a 2 family home in Jersey City, NJ. Purchased it in August 2013. Now both tenants complain about bed bugs. I got an exterminator to do the proper treatment. I paid $600 for this job. Tenants are still complaing about bed bugs, so I need to do the second treatmeant. My question is is the LL still respoible for second treatment? I want the tenant to pay for the second part. Can someone help with NJ laws? --65.118.xxx.xxx
