State Specific Question About: FLORIDA (FL)

Hello!

My rental is a single family and had a fence on all three sides of the backyard. The next door neighbor owned the wooden fence on one side and decided to take it down cuz it was old. Now this rental has only 2 sides fenced. What is my responsibility? She has a 4 yr old and a dog she snuck in there. She has asked if there is anyway I could put up a fence on that one side. thank you

You do not control what the neighbor does WITH HIS FENCE.

It is your responsibility to care for your property not that of your neighbor.

she could put in a plastic fence for a low cost if she is so concerned about the child. The dog....well it is a no pets property, right? Send her a violation notice to get rid of the dog. --70.192.xx.xxx

Fences are governed in most cases by state law. I don't know FL law on this issue. In the West you fence people out.

Since she rented the property with a fence, even though it wasn't yours, unless the lease specifies otherwise, she would be entitled to a fence.

The unauthorized dog is another issue. Notice to correct or pet application and pet rent would be in order. --75.160.xxx.xxx

I think I would charge a pet registration fee plus a monthly pet fee back to the start of the tenancy since she broke the lease and snuck a dog in, and use that money to install a fence where the old one was.

not sure where Bill is coming from. maybe cut back on the whiskey. it was neighbour's fence. neighbour took it down.

when LL rented the property it was fenced. that did not mean LL has to replace neighbour's fence.

having said that, I have always put up a fence at every house I have bought. easily adds $150-200 to rents.

and, as it happens, I just replaced a fence next to property that I own that belonged to neighbor. old fence falling down, I split cost with her because she wanted fence, but put it within my property line. so now my fence. --97.94.xxx.xxx

You may have no responsibility.. in the matter

Lots of towns, counties have little or no rules on fences..

they are simply something a developer would put in...

As you point out.. you were told the fence belongs to the neighbor.. and may be on their property..

So there may be no mandate on having a fence...

However... i'd suggest

See what the neighbor may want to do.... rebuilt it?

and go from there... of course it makes your home better by far....

Since you rented your property with a closed in yard, and now one of 3 sides is missing, I would assume you have a few choices:

1) Reduce the tenants rent because you have diminished services.

2) Talk to your neighbor and split the cost to replace the fence.

3) Replace the one section yourself, but on your side of the boundary.

I would offer to stretch up one of those plastic construction fences to help her child stay in the yard, the dog - well that is a whole new unauthorized pet problem requiring a registration fee and maybe renters insurance depending on what your pet policy requires - if no pets then time to get the pet back where it came from, which is not your problem in any way. --75.94.xxx.xxx

Unauthorized pet? Present her with back fees for pet, including nonrefundable deposit. Tell her if she wants to keep the pet, she will owe $$ additional monthly rent and you will replace the fence at your cost. Otherwise, she gets rid of the pet.

If the existing fence was not on your property, I believe you have no requirement to replace it. Look at it like this: If you live in the country and everyone had hundreds of acres, and your neighbor has a fence that starts 3 acres inside his property, do you have a fenced yard? You have to cross his property to get to the fence.

The same holds true if the fence is only 1 foot on the neighbor's property.

The only concern I would have is if your lease or advertising listed the yard as "fenced". Then I would say you need to replace the fence, on YOUR property. --141.129.x.xx
