State Specific Question About: GEORGIA (GA)

I have a tenant who my company filed a dispo on. They decided to give us a 30 day notice at court and move out (agreeing to pay for that month). They did not pay for the month, moved out and the utilities are off. Can I consider this property abandoned and take possession or do I need to go back through the dispo/writ stage? The house is full of trash, old sofa and a big screen TV. --71.14.x.xx

They have provided you with their 30 day notice in court. If the 30 days have passed, they have completed their agreement (except paying for the month, the deadbeats).

There is no reason you need to go back through the dispossessory/writ of possession stages.

If the beds are gone and utilities are off then more then likely the tenant will not becoming back. Take pictures of every room along with the bedrooms to show the beds are gone. Next throw out anything which is rotten. Separate what is useable which can be given to charities. Change the locks by rekeying the deadbolts by taking the deadbolts to a locksmith. Report the deadbeat tenants to the credit bureaus where in short time they will the same the next place they are moving in. Also consider contacting a landlords association by going into google to see what legal action can be taken. If they work then tracing them to take them to small claims court for a judgement to cover any rent arrears along with cost of cleaning up a thoroughly trashed out rental unit. Take pictures then write down the costs of cleaning up the rental unit along any damage done. --74.220.xxx.xxx

Did you get a consent order/judgement when you went to court? If you did, you must file an "Affidavit of Default" with the court. The court will issue an instanter writ of possession and a judgment for the rent that was due.
