State Specific Question About: GEORGIA (GA)

Tenant moved out and left washer and dryer that she rented in unit, it has been over 120 days. Recently notified by current tenant that old tenant confronted her about gaining access to property to get unit, I notified old tenant that it is now considered abandoned property, looking for feedback on how to proceed. --98.252.xxx.xx

Have you checked and fully followed any abandoned property laws for your state? Are you absolutely sure that you can call it abandoned property and they have no claim to it?

If so, then I think you're fine. But I'd want to be very, very sure. In some states, you'd have to store it even though they "abandoned" it and make it available to them, unfortunately.

going forward, if anything is abandoned, I'd remove it. not fair for your new tenant to have to deal with that. If the items are no longer on the property, that's all the new people need to say ... "no washer and dryer was here when I moved in".

for the current situation, as others have said, did you follow the law correctly? if so, tell them to take a hike and don't bother anyone again. --72.95.xx.xxx

I am not really familiar with the rented appliance business, but if I found appliances left on my property that I knew belonged to a rent-it-center, I would prbobably have called the rent-it-center to report it to them and to let them come and pick their stuff up.

At a minimum you are required to send notice to the tenant that they have left property behind with some time limit (state dependent) that once expires you can dispose of it (state dependent). Imagine if they left gold bars behind and you chose not to inform them of it hoping they would forget and then you could claim them as yours. If you never sent them a notification it would best to let them take their property back because they could take you to court. --96.42.xxx.xxx

And Georgia does not require that a landlord store a former tenants property for a certain amount of time until they get their rear end in gear to come and pick it up.

The number of LLs willing to lie and compromise their own principles just to avoid dealing with little things like this is amazing (and sad) to me.

If your state doesn't require it to be stored and considers it legally yours to do with as you please, then why lie about it? If the law backs you up, then so be it! No need to lie if the law is with you...

I missed it too about the appliances being rented. I also would have called the rental place.

I did call the cable company twice this past year about cable boxes and remotes being left at my properties. They didn't care at all ... said if I wanted to bring them in that was fine ... since they didn't care and the extenants didn't care, neither did I. Sat the stuff at the curb and it was gone. --72.95.xx.xxx

If the appliances were rented from a rental center with their usual labels, call them to pick them up. It is their property - not yours or the tenant.

However, once I had a renter who had purchased a used dryer from a rental center, so it was completely his. He left it. I kept it in the basement for a couple of years and then finally changed the cord on the electric dryer so it could be used. Every jurisdiction has a certain time period a tenant can claim any belongings or property left in the rental. After that time period the rental housing provider can sell, give or dispose of anything left behind. Here after 72 hours the tenant can not claim anything left behind so that is the end of the story. Check with the landlord and tenant statutes in the state to determine the time period. Yes and no -- the situation can change when they don't actually OWN the item, IMO.

If they had leased a car and left it in the driveway -- it wouldn't magically become the LL's car even in state with abandonment clauses -- because the car was leased and doesn't belong to them.

I don't see where OP mentioned a rental center. GailK is correct, Ga doesn't require us to store property. In fact here we can set it out that day and be done with it. I don't think I would have handled it any differently if it had been a rental. The contract is with the tenant not me. I am not required to store or call them for pick up. Rental centers know very well how their business works. The probably have alot of skips. Hence why they charge such a high amount for the rentals in the first place. --98.94.xx.xxx
