If you've never done it before and/or don't know how (and based on your question, I'm thinking that is the case) I recommend hiring a local, experienced, flat-fee, land lord/tenant attorney who specializes in evictions and is the legal equivalent of a pit bull. This should be someone who is in court every week handling these sorts of cases. They will do it right, quickly, and will be available to answer any questions that you have and also respond to any tenant drama that can/will occur. Whereas if you try to DIY it's easy to screw up the first time and have to start over from scratch and/or get sued for violating the tenant's right. Expect to pay anywhere from $250 - $500 for a simple eviction...more if the tenant contests it and it goes to trial. Still cheaper than doing it yourself and messing up / taking too long.

Yes, even deadbeats have right...as "wrong" as that may seem. Good luck...we've all been there at one time or another. We all survived.

A recommendation: the only communication you need to accept from this tenant now is "I am taking to rent to deposit in your bank today." Anything else (yes, seriously, ANYTHING else) is drama/B.S. and should be ignored since it will be you arguing over pointless things that will not get you paid. They will try every excuse and threat in the book to make their problem into your problem.

I let phone calls from evictees go to voice mail and don't return the calls until I see the money hit my bank and they are PAID IN FULL. As you can imagine, that means I rarely, if ever, return any calls. At this point...99.99% chance they are going on the curb along with all their stuff. --108.250.xxx.xxx

Is there a reason you chose to send a 30 day notice instead of a 5 day pay or quit? I'm not familiar with AZ laws to know if there is an advantage of the 30 day notice over the 5 day. --50.129.xx.xxx

You could try cash for keys as well. I know it hurts but you could offer them some money to move. Obviously your offer would be less that what it would take to go SID's route. This offer would be move all your stuff by 5 pm Wed and I'll forego the eviction and pay you $150 to cover the cost of a moving truck. Sign here. One should contact a landlords association where one can google to find a association near the rental. Keep careful records on the arrears of rent and amount owed on the utilities. Once the paperwork is filed with the court one will get a hearing date and time. If the tenant does not show up at the hearing then one will get a judgement for the arrears of rent and writ possession for the sheriffs office. Make sure all the spelling and facts on the paperwork are correct that is filed with the court. --74.220.xxx.xx

After filing for eviction, but prior to the set out date, we received a certified letter from tenants, complaining that the central heat is not working. They are using space heaters now. October in SC was above average temperature, with only 1 night below freezing. Tenants called us about the heat after the eviction was in process, and we have been talking them through the steps of turning the heat on for the season over the phone. We are reluctant to repair heat, as tenants should not be there anyway, "staying without paying", and supplying heat will encourage them to stay longer.

We asked tenants for a firm move out date, and were told "We have no place to go." Since they have not paid rent, and both tenants work, moving $ should be no problem. We will review the tenant landlord act, and especially what the triple damages clause pertains to before replying back.

What have others experienced? Your advice is most appreciated. Thanks!

Joanne- You should start a new thread for your question. Get the heat working, it does not matter that they have not paid and it may hurt your case for possession. It will definitely reduce any money judgment you would get. They could also contact the health department which could cost you more in fines. --50.129.xx.xxx
