The gas and electric are in my name and the tenant has agreed to reimburse me each month in addition to the rent. Not only is my tenant two months behind in rent, she is also two months behind in reimbursing me for the utilities. Can I give her notice that if the utilities are not paid by a specific date, I have the right to disconnect her utilities? October 14, I gave her a 30 day eviction notice to be out by November 14. I need to get her out of the unit and thought no utilities might be the way to go. State Specific Question About: ARIZONA (AZ)

Why a 30 day notice,I assume your state has a much shorter length of time for eviction for non payment of rent.You need to call an attorney tomorrow and evict this person properly.You cannot turn off the utilities --24.92.xx.xxx

No, you can not turn off her utilities. Hire an eviction attorney tomorrow. Do not try to do this yourself. Unless you already know an attorney, go to your local Courthouse tomorrow and ask the clerk there which attorney does the most evictions. Call that attorney and ask for a quote. A flat fee is better. If the tenant is in arrears of rent then evict for arrears of rent. Under no circumstances should anyone given a rental home or apartment if they have any arrears of utilities. If someone has arrears of natural gas or hydro electric then rent is going to be issue as well. Before anyone moves into a rental unit the utilities must be in the tenants name no exceptons. That is why it is important to run a thorough credit check on all adult applicants. Most juridictions it is illegal to turn off any utilities even if the tenant is in arrears of rent. What they tell you then when they move is completely different don't be surprized. Unfortunately utilities and rent go hand in hand. --74.220.xxx.xx

I had squatters break into a 4 bedroom home the day after my tenants moved out and ordered the utility companies to terminate service. Afterwards the squatters contacted the Health Department and reported their tenancy without service. Until the owner gave them a valid lease they couldn't turn on new service. So the Health Department ordered me (the owner of 20 years) to provide these squatters with a lease so they can have water, power and gas for heating.

If I refused to comply the City Attorney would file a case against me, have me charged, arrested and fined. I had already contacted my attorney and was awaiting trial for an eviction.

Look back here very recently the whole AZ eviction notice was layed out by another post, you need to know your local and state laws whichyou do not so to get this under control the quickest hire an eviction service lawyer, no other lawyer understands the process and timeline we must work with, they file motions and this means the tenant will be in your place 3-4-6 months while they learn how to do it properly, I strongly suggest a visit to a landlord meeting in your area or to housing court where you will see one of these lawyers in action, up to the bench and you hear judge grant moveout in 10 days, he goes with another folder and eviction granted 10 days - get his business card and make 3 copies of your lease for him to work with. stop all communication with tenant until judge hears your case, this is why we hire the court to take over, let them do their job which is helping you get back your place. --75.94.xxx.xxx

Pay the utility bills. Don't threaten to shut them off. Call a flat fee eviction attorney today and get the eviction process started. The legal fees, lost rent, and utility bills are your tuition to landlord university. Observe what your attorney does so you will know the process yourself next time around. --50.129.xx.xxx
