I have a lease signed with a tenant stating that tenants are responsible for all maintenance and repairs. That includes the furnace and AC units. But are landlords responsible for maintaining furnaces and AC units according to Ohio law? --24.171.xxx.x |

I don't know about OH law, but from a common sense standpoint the LAST thing I'd want is some tenant's drunk brother-in-law that just got out of prison and who thinks he knows how to fix a furnace goes poking and prodding around on my $3500 HVAC system, cracking the heat exchanger in the process and filling my rental unit with toxic carbon monoxide.
I've never done a lease like what you're describing, but the horror stories I hear from other land lords who have do it is any repair/maintenance TENANTS do will be done as cheaply as possible or neglected, and 5 years later when they move out there's all sorts of deferred maintenance and shoddy workmanship that results in greater damages. On that basis alone, I'd rethink this unless this is a commercial lease where tenant maintenance is a standard expectation.

A natural gas boiler or furnace requires the heat exchanger to be cleaned every two years where every month the filter is cleaned or replaced. Other then a break down the furnace should last. If the furnace is older then the furnace is at the end of life expectancy. Most jurisdictions the owner is responsible for maintenance on a rental unit. --74.220.xxx.xxx |

Ohio law does show owner responsible for equipment and renter for providing fuel, what would make you think a renter could fix anything? This is why they rent, do your filters 2 times a year so you can see deep into the place. --75.94.xxx.xxx |
