State Specific Question About: PENNSYLVANIA (PA)

If the tenant moved in to a house with a screen door that had a ripped screen but the whole door was replaced with a screen door too big for the doorway but we nailed wood to the house and installed the new door then that door broke after a few weeks of wear and tear, who is to pay for that? The landlord or the tenant? There was no foul play here just wear and tear. --98.237.xx.xx

We remove screen doors when they break. If a tenant calls and says 'it broke' we simply take it down - I tell people, "We are getting out of the screen door replacement business." Last time I said this to a tenant, she said, "No no we'll fix it!" and they did.

Sounds like the replacement door was not installed properly in the first place so it seems like the breakage could come from the poor installation. I would remove it and leave it off or do it right. --69.141.xxx.xxx

I am the tenant in this situation. The screen door that was installed was more of a 'doesn't fit but we will make it fit' since the one he brought was way too big for the doorway and instead of getting one that fits he rigged this one to work. It is the most used door so any cheaply installed door would have the same fate. I am in the process of sending him a letter stating to fix it by 12/1 or I will and deduct it from rent. I was just wondering if this was a proper circumstance for that. --98.237.xx.xx

By sending that letter, sounds like you are looking to move. Try taking it easier on those doors. Don't push on the screen itself. Push on the wood part. Try not slamming it so hard as well. With proper care it should last a long time. --76.97.xx.xx

I'm in the lease until next summer so moving isn't an option at the moment, the hinge of the door snapped the wood in half that was nailed to the house. The coils in that hinge seems to be too strong as it is a struggle just to move it now, the bottom is not as tough and there was no breakage there. --98.237.xx.xx

Chris - this does not fall under habitability, so in most states you cannot do this. Many landlords do not provide storm/screen doors at all. They are very fragile and create a lot of problems.

BTW - the threat of "if you don't fix this I'll withhold rent" does not make a landlord have warm fuzzies for you, the tenant. I suggest treading very lightly. --70.16.xx.xxx

Chris, I agree, if it is one of those cheapo screen doors (20 bux from Home Depot) it isn't worth the powder to blow it to hell. If it is a more expensive, metal one, it should last at least ten years. The three screen doors on my personal home are all at least 50 years old, but those at my tenants' homes seem to last for one tenant only. Like WMH, I no longer replace screen doors on all but my most expensive rentals. If you are paying less than 800 a month, just ask your landlord to remove it. --24.31.xxx.xx

Chris, I have more than my share of rentals, most of them older dwellings,Countless times I have driven by a property and seen the storm/scree door propped open with a chair, or some other item.I can have a perfectly functional storm door with no parts missing, and I assure you it will be broken within the first 6 months of occupancy, if it's om a rental dwelling.

That being said, If I were you, I would politely ask (verbally) the landlord to fix the screen. You will have a much better relationship with him that way than if you mail him a letter.

This is the exact reason why I take them off once I buy a house for a rental. They are nothing but problems.

In PA, withholding rent for this would be a quick way out onto the street. With small town local Magistrates, if I file on the second, I can usually get them out by the 30th of the month for non payment of rent. Chris, it's best not to try that route. --76.6.xx.xx

Chris I'll start at the top - you said "There was no foul play here just wear and tear." Something that only lasts a week is not wear and tear. Now called into question the door install but you said "we nailed wood to the house." It seems like your installation didn't work with your use. Not sure how anyone but you would be responsible for that one.

Later on, after confessing you were the tenant (contrary to what was implied by the first post) you said , "he rigged this one to work".

It seems you started out pretending to be someone (LL) you were not (lying?). Makes us wonder what other facts you are leaving out or misrepresenting. BillS: Exactly -- I think the LL is actually who nailed the wood to the house, not Chris. In Chris's first post, I think he was pretending to be a LL like us. Only later does he admit that he's a tenant and was, therefore, lying to us.

So, I think he didn't actually nail the wood to the house. His story changed along the way...

Chris: If that is not accurate and you actually did the wood nailing, please explain the situation better.

Actually, it sounds like someone let go of the door and the wind snapped the hinges off. Or had to move a big piece of furniture in and opened it farther than it should.

That doesn't excuse the landlord from doing a poor job but you are not entitled to a screen door. Your living space starts a fraction of an inch inside of each room wall and the outside and door is a common area that belongs to the landlord. --69.141.xxx.xxx
