State Specific Question About: MASSACHUSETTS (MA)

First time ever raising rent. Tenant is month-to-month. I am of the assumption in Massachusetts that I have to send them a notice to terminate tenancy ( giving them a full rental period notice). Then they have to sign a new rental agreement at the higher rental amount. The normal notice to terminate tenancy is usually sent to tenants I am evicting. That is not the case here, but I'm actually hoping tenant moves out. Don't want to mess this up- tenant is a smart PITA. --24.177.xxx.xx

interesting, I don't know about MA, just stop in to comment that it's interesting that you would have to end the tenancy and to raise the rent. One would assume that would be the same as giving 30 day notice to raise the rent or a pay and stay notice. Hope someone comes along familiar with your state law and comments. --173.119.xx.xxx

Rents Due, you are correct you have to give written notice to terminate the existing rental agreement (MTM or term lease) & is you like you may offer them a new rental agreement with any changes / new terms (like a rent increase). This notice must be received at least 1 full rental period B/4 the start of the next rental period. If you really want them gone just bump the rent up substantially.

Presuming that your agreement runs from the 1st to the end of the month, if you give proper notice on or B/4 the 31st of October, the change would be effective 12/01/13. --100.0.xx.xx

My legal in NJ notice says that the tenancy is terminated but the tenant can rerent the premises on such and such a date for the new amount of $X.

If the tenant remains in the apartment after such and such date, it is assumed that the tenant agrees to the rent increase even if the tenant does not respond to the notice. --69.142.xx.xxx

Thanks Steve, that is what I thought. If they do not sign the new Rental Agreement, then the tenancy is still terminated. But, in Massachusetts that doesn't mean much. If they don't pay the increase, I don't think it is considered the same as an eviction based on non payment of rent...because it is an increase. If I had to get an eviction it would be a "No Cause" or "No Fault" eviction and they would be entitled to stays (that our court here loves to give). This increase is not substantial- just her reward for being a PITA. This tenant needs to be trained. She knows this increase is a result of her own pettiness (called me at night wanting the filter in her refrigerator water dispenser changes ASAP. No filter for her- just a rent increase. This isn't even her most ridiculous demand. I have given into none. Every time she calls with a request like this she will get another rent increase.Eventually she will either stop calling about dumb stuff (trained) or leave. --24.177.xxx.xx

Changing out a filter is not a emergency which can wait the next day. In the apartments have a basic fridge without a water dispensor. One of the reasons they are tenants is they will never be able do a lot of simple maintenance items themselves if they ever buy a house where calling someone is expensive. Fortunately they removed the insane rent control in Massachusetts which would prevent a rent increase. Those on the left said the sky would fall if they removed rent control which did not happen. --74.220.xxx.xxx

They are only as PITA as we allow.

No need to answer the phone at night. That's why God made answering machines and voice mail.

Also know that the younger they are the less polite they are.

Millenials live on their phone even thru the night, so they don't go by my Mom's old rule about being impolite to call after 9 pm.

Let them leave the message about a filter, just call back in the morning and schedule it for the next day.

I'm not looking for pleasant attitudes, I'm looking for steady rent without vacancies. Both make me FREE!!! --67.175.xx.xxx

Just give them a 30 Day Notice to Quit with no explanation/reason.

Just repeat over and over, "I just want possession" to the tenant, the Mediatior, the Judge.

Any specific reason you give WILL be used against you, especially by "smart" tenants.

Give them the 30 Day NTQ immediately. Do not discuss it with them in advance as that will give them enough time to call Health Inspectors in. Then your eviction will look like retaliation.

Have it served by a Sheriff/Constable. It's about $35, but that really shakes the tenants up = may move out before.
