You're required to use your own lease. The housing authority should not be supplying a model lease.

In addition to your lease, there is a HUD-required contract between the landlord and the housing authority ("HAP contract"). You can review it by opening Form HUD-52641 at portal.hud.gov/hudportal/HUD?src=/program_offices/public_indian_housing/programs/hcv/forms/forms. --184.177.xxx.xx

This varies GREATLY by area. Sec8 is, generally, controlled by the local housing authority. MANY of them absolutely DO provide a model lease that they EXPECT you to use. I actually had to tell my local office that I wasn't going to use their lease and would be using my own instead. We just did the add-on HUD contract agreement only.

(Heck, their sample lease wasn't even legal/proper for my state! It actually ignored several legal requirements that are supposed to be in there.)

So, Joe, you'll want to ask your local Sec8 office about this. As far as Sec8 goes, because it SO depends on the local office, I always recommend this:

Call your local office that you'd be dealing with. If you get a human or need to leave a message, tell them that you are a local Landlord interested in getting more information on their program and how it works. If someone gets back to you with that info within 48 hours, then consider Sec8. If you don't hear back with the right info that answers your questions within that 48 hour period -- then DON'T DO SEC8.

It's ALL about the local office. Mine is great -- others are not. (Note that even though they are great, I still just have ONE Sec8 tenant.)

The last Sec 8 I leased the housing authority provided the lease. Had things like 100k liability policy to be maintained by me.

She's been in the house 14 years so things might have changed.

FWIW Sec 8 in my hood is $150/mo BELOW market. Hence I have not filled a vacancy Sec 8 in years. --24.128.xxx.x
