State Specific Question About: PENNSYLVANIA (PA)

I'm finally getting rid of the worst tenant that I've had. But they tell me that they can't move everything out by this coming Tuesday because of a disability.

As far as their possessions they leave behind, I wanted to have them moved to a 1 month Storage Unit so I can start showing the property, but they told me I was legally obligated to keep their possessions in the apartment (or basement) for at least 20 days and not move them. Is she correct according to Pa Law?

Do I have to keep their possessions in the apartment (or basement) for 20 days, or can I haul them out and reshow immediately?

You would be well served by googling the State of PA LL regulations and/or asking an atty.

Get them to agree it can go to the storage unit,it will be more convenient for them since they will have the key,anything to get there junk out of the unit,if they agree to it there should be no problems. --24.92.xx.xxx

you haven't given enough details as to how & why they're leaving.

tenant is wrong - there is no 20 day anything... but there is "10 day stuff" and "30 day stuff"

PA law of long standing specifies the landlord may move tenant possessions to "reasonable storage" of their convenience. A few local areas have added restrictions.

The new state law sets a time line for when LLs can dispose of former tenant possessions without fear of being sued. It says nothing about where the possessions are to be held. I could easily argue that a storage facility locker is more secure than a vacant residence. Take pictures and don't drop anything! --68.83.xxx.xx

The new law is that the tenant has 10 days in which to make arrangements with you to retrieve their stuff within the next 30 days. If they don't make arrangements within the first 10 days, you can chuck their stuff on Day 11.

But it sounds like they did make arrangements with you to get their stuff, so you will need to hang onto it until then (but no longer than 30 days). It doesn't need to be stored in the apt or basement. Definitely take pictures prior to touching anything because you just know they will accuse you of damaging something. --74.47.xxx.xx
