State Specific Question About: MASSACHUSETTS (MA)
I am in the process of evicting a tenant for non-payment. They have called every board and inspector trying to find validate a deficiency in the house. No inspector has found a major violation. The only violation was there were 2 unregistered vehicle on the property, only one is allowed.
Now they are claiming the other tenant is harassing them ands they do not feel safe. I know this is a ploy, they have not ever mentioned harassment to any inspector. Do I have to report this claim? How do I act on this claim? --71.233.xx.xxx |

I hope you served them with the 14 Day NTQ BEFORE they called the city down on you.
If so, the courts will quickly recognize that as "Retaliation" and heavily discount anything the inspectors find.
On the other hand, if you served the 14 Day NTQ AFTER the inspections, then the court will view your actions as "Retaliation" and will likely throw your case out.
In general, when you decide to evict do not give them any inkling that you are pulling the trigger. That just gives them time to call the inspectors before you serve them. Then they have just set you up for the "Retaliation" defense. --50.136.xx.xxx |

Here they must pay rent into court escrow, without having a balance is escrow the eviction moves forward and the inspector/s will come to the empty unit to give the blessing, it reads like you have the blessing - that would mean the rent paid will be released to you for back rent. --75.94.xxx.xxx |

When in court and before a judge for eviction, that's when you need proof that your tenant has made up claims after they were served with the Notice to Pay Rent or Quit.
The last time I was in court my tenants said, "we notified our landlord that we had "no hot water", "no furnace heat", "toilet wasn't flushing down" and "our security bars don't release in the bedroom". I showed the judge the "dates" of the complaints to the City Departments, all after when the tenants received the eviction papers AND NOT BEFORE. Also the findings posted by those departments, "complaint closed upon inspection" -- meaning it wasn't true.

The last rent received was for May, when pressed for June's rent they said they were moving out by july 31st and would pay prior to moving both verbally and in text. No move out, no pay rent, kept promising payment. August 16th, 14 notice for non-payment, August 30th summary process.
They claimed to have called board of health in june, I never heard anything. In court answer the tenant claim no action was taken because, "I knew everyone in town", though I have never met nor have any influence with anyone in the regoinal board of health.
After 14 notice, they notified fire dept, building inspector, MA DEP, town manager and plumbing inspector. --71.233.xx.xxx |

LOL, just got one like that out. The place was so "terrible" I was a f*^%$#@ slumlord, yet it took the sheriff dragging (yes, he had to get abnormally stern with the tenant) to get him out. And the tenant thru a tempertantrum in the unit that I got stuck cleaning up. (And yes folks, he came with good references from established apartment complex...they lied). You gotta wonder why they fight so hard to stay in such a "terrible" situation.
Anyhow, continue going thru on unlawful detainer or whatever it is called in your area. Quit talking to him and only accept communication in writing. When you get to court shut up (and I say that with kindness). Let the tenant hang himself in court.
