State Specific Question About: NEW HAMPSHIRE (NH)

It was mentioned to me today by an associate that no one has ever won an eviction case for refusal to re-certify household information. I tried to look it up without success, and I have a really hard time believing this. Does anyone have experience with an LIHTC eviction for refusal to re-certify? --107.3.xx.xxx

Do you mean basically for not filling out a new application after being there for a year?I wouldn't bother asking for it since they won't bother to fill it out and it is not worth it to kick someone out over that,I just update my file after speaking with them in casual conversation.Most tenants are happy to brag when they get a new job so I just say good for where are you working now and they will tell me and I write it in the file for future reference,other than that I just need new phone numbers. --24.92.xx.xxx

I have never been part of the Low Income Housing Tax Credit program, and I am not familiar with the program requirements.

Does HUD require you to file annual papers with them, for which you need information updates from your tenants?

If you need to verify that your tenants remain eligible to reside in your housing in order for you to get the tax credits, then your lease should specify the tenant's obligation to provide you with the necessary information, and that should be a breach that is grounds for eviction.

You do realize, I hope, that it is dificult to get information on eviction cases that do not get appealed, right? Most evictions are not reported in the local newspapers or in law reports. So even if there are LIHTC evictions, you would probably not know about them.
