Two questions actually, can I garnish NY State Income taxes for a civil judgement caused by a tenant?

Second, is warning other landlords about bad tenants considered harassment of the (former) tenant? --24.97.xx.xx

1.) unknown - but likely expensive with time, if you are a court hound you may be able to do it far cheaper than any collection service

I don't think telling a prospective LL the truth would warrant harassment. Stick to the truth. Or say something along the lines of your "more than happy to say something positive about a good tenant without their consent. Will need consent form to talk about that tenant."

As for garnishing tax's. I don't think you can do that, but let's hope someone comes on here and tells you I was wrong. --71.176.xx.xx

I have not heard of anyone in NY garnishing tax returns but you can garnishee wages in NY and a bank account but there has to be more than about $1700 You can have a sheriff seize a motor vehicle and auction it but I have never done that --24.92.xx.xxx

Thank you for your responses. It seems almost useless to garnish the wages of someone who works part time in a c-store. As for the motor vehicle, it's a $450 fee to have it seized/auctioned and the vehicle is a p.o.s anyway. --67.252.xx.xx

Question #2: depends on what you do.

If the new LL calls and asks, stick to PROVABLE FACTS.

If you want to place an ad in the newspaper telling the world about these scumbags, then no.

To help "spread the word" get a court judgment on record - it will ding their credit score and IF the new LL checks he/she will see the problem.

If you do not want to pay for court or cannot locate the res for court, MrLL has a service on this site. For a small fee you can report their non-payment to the credit bureaus.
