I forgot to notify my tenant that her rent payments were not coming to me. This happened for about 12 months. I did collect a few months.

I KNOW. I feel stupid too. I am wondering if in MASS can I still go after all past due rent if I have accepted a few recently. She said she didn't know her rent wasn't being delivered.

Does she have a case? Have I given up any rights because I accepted partial rent from her. If anyone has specific knowledge whether 14-day is necessary before I sue her I'd appreciate it.

I don't know the landlord/tenants law for MA, the best advice I can give you is to find an eviction attorney and get rid of her.

Does she have a case? No, you can prove that she hasn't pay you rent for 12 months, get her out ASAP.

Take out your 3 ring binder that a copy of your state and local tenant laws - read it 3 times cover to cover!

If you feel you still can go after the rent then by all means...

The money received by the LL goes to the BALANCE DUE, not that month.

Make a written list of money rec'd and rent due.

Normally you can sue for the unpaid balance.

Thanks everyone. I don't actually have this tenant; it's a friends 21yo daughter. She has been paying her rent for a year and delivered two or three to the landlord herself. The rest her Boyfriend "Delivered"

She's a nice girl and I wanted to get opinions from you of the landlord, who said he never got the rent. She found out after innocently giving her 30 day notice. He then said she owed $4000.

I know this forum is for landlords, but I've never heard of this type of thing. If he didn't notify her, then she had no way to change the way she paid him, right? A year. Any of you landlords actually think this was fair to her? Why on earth wouldn't you send 14-day notice after 10th day? I would! Sorry for the "white lie" but I wanted real opinions, and I must admit, it was hilarious to see your comments! All the "dump your property" advice is duly noted and I agree, this guy should dump his property. If you want, I'll let you know how it goes. She goes to court this morning to fight him. I suspect this is purely hypothetical, but if the landlord allowed this "nice" girl to steal from him for a year then he/she should indeed sell.

As for the question on if it is fair that your friends daughter is now being forced to pay what she owes... it sure is fair, Toots. I ask you, is it fair that the renter stole from the landlord from a year? Just because you are not caught or made to be held responsible doesn't excuse the crime.

Golly. We see this all the time.

Young naive girls falling for this scam - Guy lives rent free for a few months while playing honeymoon.

She probably signed joint and severally which means if SHE has a job, she can be garnished fro the full amount. This will be a hit on her credit.

He is probably smart enough to avoid the court and garnishment.

IF notices were sent, the guy hide them. Not the LL's problem.

I suggest

1. parents step up and teach their daughter. My observation is these girls will do this again.

2. she quickly negotiate a settlement amount with the LL. Obviously the LL is not interested in money or he would have evicted long ago, so she might be able to end this for a nominal amount to clear her name. --67.175.xx.xxx

Actually...

My sister used to pay her rent in cash. Put it in an envelope and gave it to her husband to pay (she worked and he didn't).

Guess what? Husband took the money and spent it on himself, they got evicted for non-payment. Divorce ensued. --12.176.xx.xxx

Do you want to hear what happened?

The landlord was getting notes from the boyfriend stating that he only had $40, $25, etc for a long time. He had kept the notes and agreed that the boyfriend forged her signature (showed the court.) She had to pay $1500 and had the opportunity to go after the boyfriend, which she didn't want to do. The boyfriend was added to the docket last minute since the LL didn't put him on.

Don't need the attitudes, but sometimes I have seen questions raised that would not be supported any other way BUT the LL's. I get it, but you don't have to be so rude. Thanks. --72.79.xxx.xxx
