State Specific Question About: TEXAS (TX)

I have a tenant who is moving out after paying one months rent and deposit and only staying there one month. I am actually glad they are moving out as they have been leaving trash everywhere and stirring up trouble in the short time they have been there. I heard from another tenant the guy lost his job. However, they never contacted me about this and have avoided me completely. I am issuing them a 3 day notice to vacate on Monday. Because they are essentially breaking their lease and have gone about it in such a bad way, how and who should I report this to so that there is a record of this bad behavior? --99.91.x.xxx

If they are leaving soon and it appears obvious I would not give them the 3 day notice,if they move without notice I could sue in small claims for this month and next month and damages,when you file the judgment it will be picked up by the credit reporting agencies --24.92.xx.xxx

Scott, Time to take action to protect yourself.

Have him sign an agreement showing what he owes,

when he will be out, and

his forwarding address.

I would not bother reporting him unless he leaves a HUGE bill. This is just basic, everyday LLing.

He is probably assuming you will just apply his deposit as his last month's rent.

Studies show that most renters do not expect to get their deposit back.

My fear at this point is a guy who drags out the moving process, days passing unpaid, and junk/cleaning left for me.

Demanding and yelling does no good - you need his cooperation at this point.

We screen like crazy before we let them in, but things change. Jobs are lost, divorce, sickness, deaths...

Just keep track as best you can and react when you learn about changes.

Brad, that is not legal in Texas - Section 92.108 of the Texas Property Code provides that a tenant may not withhold payment of any portion of the last month’s rent on grounds that the security deposit is security for unpaid rent.

You can go after the tenant for Bad faith violations for Section 92.108 may subject a tenant to liability up to 3 times the rent wrongfully withheld and the landlord’s reasonable attorney’s fees.

This is easier than getting a judge to approve late fees which is why in Texas, your rental agreement should state that you apply any money to fees first and rent last. --99.126.xx.xx

I am going to post a 3 day notice to vacate on his front door tomorrow since rent has not been paid and no commication has been made to notify me of anything. I have called, emailed and sent text messages.

By putting the 3 day notice on the front door I will let them know I mean business and this will be my first step in the eviction process. So, if they do drag their feet and don't move out (this happens) then I will be able to get them out legally.

I will knock on the door and hand it to them if they answer -I will try to work something out. But they are getting this either way. --99.91.x.xxx

Applying the deposit towards rent is prolly illegal everywhere until they have actually turned over the keys and possession. Looks like a problem, time for a double deposit. --75.94.xxx.xxx
