One of the two tenants in an apartment went to jail. I want to terminate the tenancy of the one that went to jail but allow the other tenant to stay. How do I do that? What type of form do I use? --71.55.xxx.xxx |

Zero tolerance for criminal activity addendum, signed by all tenants.
The lease expired on the first apt. affected, and I had the remaining tenant only sign a month to month addendum.
The second apt. affected, the tenants were already month to month, so am sending the incarcerated tenant notice of termination at the end of the current month, 30 days notice, sent certified. --71.55.xxx.xxx |

Ending a month to month tenancy...yep, what you did covers it.
Btw, double check the legality of your lease clause "zero tolerance for criminal activity." Does that apply to crime committed on the property or anywhere? For what kinds of crime is there zero tolerance? I imagine you'd be okay to evict for dealing drugs out of the apartment, but a judge might laugh you out of court if your tenant just got a speeding ticket. I choose a ridiculous example just to get you thinking about how this type of policy needs to be balanced against what a judge will actually enforce. --108.250.xxx.xxx |

I have a pretty high tolerance level, as long as the conduct is not damaging my property or driving out other tenants of mine (rare, because I deal with SFRs).
When a tenant of mine was arrested for drugs, I waited until the second of the following month and posted a Five Day Notice To Pay Rent Or Quit. On the 9th, I filed for eviction.
I said nothing about drugs, arrests, jail, whatever. I kept it super-simple, T did not pay rent, end of story.

Have your tenant been to court and found guilty? If they have not you can post a 30 day notice on their door to vacate.
You said you sent the 30 day notice by certifed mail. What happens if they don't get the notice or if they get the notice an it is the 15th of the month? That would mean there would be a problem.
You can post the notice on the door of the property with all names that are on the lease. You also can take the notice down to the jail and hand deliver the notice to the person in jail.
You have to have all persons on the lease on the 30 day notice to vacate the property.

Gina, Went to jail for what?
Could be unpaid parking tickets or child support.
Jail for 48 hours or long term prison?
If they are locked up for any time they lose their job, leaving the LL unpaid.
Can the remaining roomie cove he rent?
If the jailed roomie will be gone or the offense was severe, I'd just have him sign a paper stating REMOVE ME FORM THE LEASE and you sign it too.
Know that people in this situation feel like the rug has been jerked from under their feet and are slow to give up ANYTHING stable.
