State Specific Question About: GEORGIA (GA)

Hello:

I have two questions for in the State of Georgia.

1. How soon after tenant is late paying monthly rent can a landlord file dispossessory proceeding with the Clerk of Courts for the unpaid amount.

2. I understand in Georgia, a landlord must provide a 60 day notice to terminate a rental agreement. Does the 60 day period have to begin on the 1st of a given month, or the date of the notice?

1. Interestingly, Georgia does not have a specific time period a landlord must give a tenant to remedy a situation of nonpayment of rent,only that a landlord must make a demand for such (orally or in writing, although most landlords do this in writing). In other words, you can demand a tenant pay up and if they don't do this immediately, march on down to the Clerk of Court office and begin the process. For the particular statute to review, it's 44-7-50.

I used to do a 7 day Pay or Quit. Now I use a 3 day.

2. The 60 day notice is for a tenancy at will (i.e., month to month lease) and no, it does not need to be given on the first day of the month.

I have one follow up question. Can I file a dispossessory notice for eviction with the Clerk of Courts, and send tenant a notice to terminate lease agreement (for month-to-month-lease), simultaneously? Thanks. --144.160.xxx.xx
