Sure, if you can find him, serve him papers, and have evidence showing the rent is owed that will convince a judge to award you a judgment. Then have fun attempting to collect. That's usually the hardest part. Be sure to report the debt to the credit bureaus and/or hire a collection agency. No worth your time to hound broke people. Now if you know where he banks and you suspect he has a fat account, try garnishing via the sheriff.

Btw, why did you let this person get behind 3 months? I file after 7 DAYS. Gotta stay on top of these deadbeats! They are stealing from you. --108.250.xxx.xxx

My question would be. How did they live in your home for 3 months without paying rent? I had a tenant miss his June 1 rent payment. I served the 3 day on the 3 rd, started the process, and we were able to set him out on the 27th of June. When a tenant is late, don't procrastinate, deliver the 3 day and start the process. --66.169.xxx.xxx

I like the rythme "if the tenant is late, don't procrastinate" It goes along with "If they can't pay, they can't stay".

In reality I don't evict everyone who is late. The only person that helps is their next landlord. If someone has been a good tenant for a couple years and has a financial problem I would asses the situation and probably work out a plan with them.

A big consideration would be how many similar vacancies I have at the time. Most of my tenants aren't collectable so getting a judgement is rarely worth the effort. --70.211.xx.xxx

I'll echo what TXmike said, laws in Texas are set up to favor giving the landlord back the property which can be done typically in 21-30 days. On the down side, you won't get garnishment. You can easily win in small claims and get a judgement, at best you might be able to find a bank account that has a little money in it, most likely you will sit on the judgement, get it on their credit report, and hope one day they want to buy a house and have to pay you off to clean up their credit. --108.240.xxx.xx

I gave him a 3 days notice, and took in to court, but he appealed the judge decision and wanted a new trail,and then he didn't do the paper work correct and they gave him five more day to redo the paper work and then the judge waited another 4 day to sign the order, now I have to wait another two weeks to get a date for court, by that time I will be another month and he will be there 3 months without pay. --66.194.xxx.xxx

Did your tenant not pay the rent to the court when he appealed? I have never had one appealed, but my understanding is that my court requires rent to be paid to the court before appealing. --66.169.xxx.xxx
