State Specific Question About: ILLINOIS (IL)

we have a house that the tenant has left all of her furniture, and clothes. She did take the a/c unit. we have been landlords for over thirty some years and have never had this happen. anybody know what we can do legally without paying lawyer? No phone numbers work either. --50.129.xxx.xx

Dig out her application and start calling references she put on that and see if you can find out what happened. Check the internet and see if you find any facebook page updates that might let you know what happened.

My guess is that she sold the ac unit for money and then sometime later got arrested and is now in jail.

Don't know what IL allows you to do without a lawyer but since you are asking I would recommend biting the bullet and hiring one and going through with a full blown eviction.

People don't usually leave all their personal belongings and move somewhere else. Since their personal belongings are still there it would give them reason to come after you if you don't follow the law to a tee. --75.160.xxx.xxx

How long has it been since you saw her? What makes you think the property is abandoned?

What I usually do is a simple eviction for non-payment of rent. I serve a Five Day (in NV) Notice To Pay Rent Or Quit. If the property really is abandoned, there will be no response to this notice, and I evict. If the tenant pays, wonderful!

Bonnie,

AC may have been stolen by anyone.

Here's our procedure:

-document ALL your actions. If this gets to court, you MUST demonstrate how you acted in a reasonable and businesslike manner, giving the res MANY opportunities to communicate with you.

-call utils. If off, ask if the res called in a shut off order or shut off for non-payment.

If res called it in, that's s great sign of abandonment

-call emergency contacts. We now require 4 per adult at lease signing.

-re-work their application - contact employer, references, etc.

-call the jail. Vinelink.com shows people in lockup.

-take pictures of the stuff. Are these unwanted clothes and junk, or good personal items like TV, computer, food in fridge, blankets/pillows for sleeping or just mattresses?

-clothes and furniture can be a fooler. Some much is available so cheap that many just leave it.

-some people only take what they can cram into a car and go. I swear most of my skips must become protected witnesses and disappear!

-I post an ABANDONED PROPERTY notice on the door. Jeffrey just printed my form in his newsletter.

I check off common items which indicate abandoned such as utils off, door unlocked, non-responsive to calls and door notices, non-paymnet of rent, no edible food, no recent meal preparation, no sleeping items other than mattress (they leave those for YOU!)

-take a picture of the notice you posted on the door.

-talk to the neighbors. "Yeah, they packed up a truck last week - ain't seen em since". Also ask them to call you if they see the res.

-after the time allotted on the notice (I give 24 hours), we start packing up their stuff but DO NOT remove it.

Start by tossing the spoilables and stinkees.

We DO NOT change the locks yet because I WANT them to come back and take their stuff without breaking a window

AND...

legally you do not have possession.

By now a few days have passed.

-If we have done all these steps to contact the res, and still no response,

take more pictures to show you handled their personal property with care,

we pile it on a trailer and deliver it to her Mom's house.

Do NOT throw it away!!!!!

What make you think that she moved and left behind everything? maybe something happened to her she might be in a hospital, or in jail, anyway before you make any decision what to do with her personal property go to google, do a search on Code 5-12-130 Landlord Remedies Illinois. if someone showed up at my home w/a trailer load of 'stuff" that didn't belong to me and attempted to dump it in my driveway, I'd:

1. call the cops

2. demand they arrest you for littering/trespassing/ harassment ... I don't care what my adult kids have done, it's not my legal responsibility (thank goodness I don't have those personal issues !!!)

3. come out w/my shot gun and ask you what you're doing

If they owe rent just put a 3 day notice or whatever timeframe your state requires on the door for non payment and do an eviction.People do leave on occasion and leave everything,especially in the ghetto neighborhoods --24.92.xx.xxx
