State Specific Question About: PENNSYLVANIA (PA)

This Q is more geared towards the LLs in PA (Nicole, NE, Brad, and others).

Have you added a paragraph or addendum to your lease to "notify tenants of their rights under PA Act 129 of 2012 (property abandonment)?

I'm trying to write a "blurb" and wanted to know if anyone else has one canned already. --140.139.xxx.xx

I haven't - I believe my local assoc. has but I haven't gotten the new format yet.

Here is what my latest Order for Possession stated - it's part of the form - the magistrate didn't just "type it in".

Notice concerning Personal Property Left in Rental Property

If you vacate the rental property and leave personal property behind in the rental property, you have ten days to contact your landlord about your intentions concerning the removal of that personal property. Your landlord is obligated to retain your personal property for thirty days if you make such a request within ten days of vacating the rental property. If no such request is made within the ten-day period, your landlord may dispose of the personal property at the end of the ten-day period. Additionally, you may be held responsible for the costs of removal or storage of your personal property after the landlord has the right to dispose of such property. Section 505.1 of the Landlord and Tenant Act of 1951 (Act), Act of April 6, 1951, P.L. 69 as amended 68 P.S. section 505.1 --72.95.xx.xxx

Wow, that's strange. Everytime I get apartments back, they're empty except for junk. I mean, I photograph the piles of JUNK they left, but never contents. THEY DIDN'T LEAVE ANY CONTENTS your honor.

My photos show the garbage and broken tv. In all honesty, like I'm going to leave that crap sit in there for 10 days. It's going in the dumpster as soon as I have the keys and they say they're out. Unless of course, they left something I want, then I'll keep it.

So, to answer your question, no new clause. Remove contents, photograph trash and go about your day. Chess game. --184.8.xxx.xx

NE - lucky that you've never had anyone who hasn't moved anything out. for whatever reason, they can't grasp that they're going to be put on the street and are still in bed when the constable shows up. I have NEVER "surprised" anyone with an eviction or possession and yet it's happened, more than once. --72.95.xx.xxx
